Par partenariat - ou union libre - il y a lieu d’entendre une communauté domestique de 2 personnes de sexe différent ou de même sexe, appelées "partenaires", qui vivent en couple et qui ont déclaré leur partenariat.
Un partenariat peut prendre fin :
- d’un commun accord par une déclaration conjointe des 2 partenaires ;
- par une déclaration unilatérale de l’un des 2 partenaires ;
- par le mariage de l’un des 2 partenaires ;
- par le décès de l’un des 2 partenaires.

Démarches préliminaires pour dénoncer un partenariat
Le partenariat peut être dénoncé de 2 façons :
- soit par une déclaration conjointe des 2 partenaires devant l’officier de l’état civil de la commune ayant reçu la déclaration de partenariat, même si depuis cette date les partenaires ont changé de domicile au Luxembourg ou ont transféré leur domicile à l’étranger ;
- soit par une déclaration unilatérale de l’un des 2 partenaires. Il faut cependant informer préalablement son partenaire de sa décision par signification délivrée par un huissier de justice.
Pièces indispensables à fournir
Les pièces suivantes sont indispensables pour mettre fin à un partenariat :
- carte d’identité en cours de validité pour les ressortissants luxembourgeois ;
- passeport en cours de validité pour les ressortissants étrangers ;
- certificat délivré par le répertoire civil auprès du Parquet général portant inscription du partenariat déclaré.
En cas de dénonciation unilatérale, il faut joindre une copie de la signification faite par voie d’huissier de justice à l’autre partenaire préalablement.
Déclaration officielle de la fin d’un partenariat
La déclaration de fin de partenariat, qu’elle soit conjointe ou unilatérale, doit se faire en personne auprès de l’officier de l’état civil compétent, c’est-à dire celui auprès duquel le partenariat a été enregistré.
Si toutes les pièces requises sont conformes :
- l’officier de l’état civil vérifie la déclaration de partenariat (certificat délivré par le répertoire civil auprès du Parquet général) et enregistre la déclaration de fin de partenariat ;
- la déclaration de fin de partenariat est ensuite transmise dans les 3 jours ouvrables au Parquet général de Luxembourg afin d’être conservée au répertoire civil.
À partir de la date de la réception par l’officier de l’état civil de la déclaration de fin de partenariat, la fin prend ses effets entre les partenaires. La fin n’est cependant opposable aux tiers qu’à compter du jour où la déclaration est inscrite sur le répertoire civil.
Après la cessation du partenariat, et pour autant que la demande ait été introduite dans les 3 mois de cette cessation, le juge de paix ordonne les mesures urgentes et provisoires justifiées par cette cessation et relatives :
- à l’occupation de la résidence commune ;
- à la personne et aux biens des partenaires ;
- aux obligations légales et contractuelles des 2 partenaires.
Il en fixe la durée de validité qui ne peut toutefois excéder un an.
