La preuve de célibat est une pièce obligatoire pour constituer le dossier de mariage ou de partenariat et atteste le célibat avéré des futurs époux/partenaires.
Ce certificat précise l’état civil des futurs époux/partenaires. Le cas échéant, il fait également mention d’un mariage antérieurement dissous (suite à un décès, divorce, annulation, etc.).
Pour être accepté par les administrations, ce certificat doit dater de moins de 3 mois.
Personnes concernées
Les futurs époux/partenaires, ressortissants luxembourgeois ou étrangers, qui souhaitent se marier ou établir un partenariat au Luxembourg doivent prouver leur célibat.
Coûts
Une taxe est perçue lors de l’établissement du certificat. Cette taxe de chancellerie est à payer à l’administration communale.

La preuve de célibat est délivrée en principe par le Bureau de la population de l’administration communale du lieu de domicile.
Pour les ressortissants luxembourgeois, une copie récente de l’acte de naissance dressé au Luxembourg fait office de preuve.
Le certificat de capacité matrimoniale pour les ressortissants luxembourgeois est délivré par le Service de l’état civil du lieu de domicile ou du dernier domicile au Luxembourg.
Pour les ressortissants étrangers, la preuve de célibat est attestée par le certificat de capacité matrimoniale.
Si ce certificat ne peut être délivré par les autorités du pays d’origine de l’intéressé (par exemple ambassade, consulat du pays d’origine au Luxembourg ou commune du lieu du dernier domicile dans le pays d’origine), il peut être remplacé par un certificat de coutume, complété par un certificat de célibat.
Pour connaître l’autorité qui peut délivrer ces pièces à l’étranger, il est conseillé de s’adresser à la commune du dernier domicile à l’étranger ou à l’ambassade compétente.
Durée de validité
Pour être accepté par les administrations, ce certificat doit dater de moins de 3 mois.
