The proof of an unmarried status is an essential document in compiling the marriage/civil partnership file as it attests to the unmarried status of the future spouses/civil partners.
The certificate indicates the marital status of the future spouses/civil partners. Where applicable, it also mentions any previously dissolved marriages (further to a death, a divorce, an annulment, etc.).
To be accepted by the administrations, the certificate must be no older than 3 months.
Who is concerned
The future spouses/partners, whether Luxembourg nationals or not, who wish to marry or engage in civil partnership in Luxembourg are required to provide proof of their unmarried status.
Costs
The issue of the certificate is subject to the payment of a tax. This chancellery tax must be paid to the communal administration.
How to proceed
Filing an application
Luxembourg nationals
The proof of unmarried status certificate is issued by the population office (bureau de la population) of the communal administration in the place of residence.
For Luxembourg nationals, a recent copy of their birth certificate prepared in Luxembourg will suffice.
For Luxembourg nationals, the certificate of legal capacity to marry is issued by the civil registry of the place of residence or of the applicant's last residence in Luxembourg.
Foreign nationals
For foreign nationals, unmarried status is attested by a certificate of legal capacity to marry.
If this certificate cannot be issued by the authorities of the interested party's country of origin (e.g. embassy or consulate in Luxembourg of the country of origin or commune of the last place of residence in the country of origin), it may be replaced by a certificate of national custom and a certificate of unmarried status.
To find out which authority can issue these documents abroad, interested parties are advised to contact the local authority where they last resided abroad, or the competent embassy.
Validity period
To be accepted by the administrations, the certificate needs to be no older than 3 months.
