If you would like someone else, such as a member of your family or a close friend, to complete online procedures through MyGuichet.lu for you, you can, with their consent, create what is known as a 'digital power of attorney'.

This power of attorney allows the other person to complete online administrative procedures through MyGuichet.lu on your behalf. You thus assume the role of principal and the other person assumes the role of agent.

This text explains how you, as the principal, can create a digital power of attorney so someone else can complete online administrative procedures through MyGuichet.lu on your behalf.

Who is concerned

Any natural person, whether they reside in Luxembourg or not, and who:

  • is of legal age; and
  • has a 13-digit Luxembourg national identification number (Matricule).

The digital power of attorney is not available for emancipated minors. They cannot entrust another person with managing their online procedures on MyGuichet.lu, nor can they carry out online procedures in the name of another person.

Depending on their role, certain restrictions apply to the principal and the agent.

The digital power of attorney is currently not available to:

  • people placed under guardianship abroad;
  • people placed under curatorship (whether in Luxembourg or abroad).

However, it is possible to create a digital power of attorney in order to carry out online procedures via MyGuichet.lu in the name of a person placed under guardianship in Luxembourg. If this is your case, please consult our dedicated information page on this subject:

People under guardianship or curatorship (whether in Luxembourg or abroad) can never carry out online procedures in the name of another person.

Preliminary steps

Setting up a private eSpace

Before setting up a digital power of attorney, both parties (i.e. the principal and the agent) must ensure they each have a private eSpace on MyGuichet.lu.

To create an eSpace, each one must have their own authentication product, i.e.:

When creating a private eSpace, a unique identifier, known as eSpace identifier (also called 'ID' or 'Espace-ID' in Luxembourgish) is assigned to each private eSpace. The eSpace identifiers of both parties must be indicat-ed when the power of attorney is created.

The following describes your situation: you created a MyGuichet.lu account a long time ago. However, you can no longer log in, for example because the authentication product you were using at the time no longer works or is no longer supported. You therefore cannot view the identifier assigned to your private eSpace. In this situation, you can submit a request to receive the identifier of your eSpace.

You can submit your request:

In your request, you must:

  • state that you can no longer access your private eSpace and that you need the identifier of your eSpace so you can create a digital power of attorney;
  • provide:
    • your 13-digit Luxembourg national identification number (Matricule); and
    • the email address the identifier should be sent to.

So your request can be processed, you must also prove your identity by showing a valid ID document:

  • if you are submitting your request through the contact form, the Helpdesk will contact you so you can send a scanned copy;
  • for a request submitted in person, you must show your ID document at the reception desk.

After your request is processed, you will receive the identifier by email.

Even if you are submitting your request in person at the Guichet.lu reception desk, you will not receive the eSpace identifier right away. You must provide an email address to which the identifier will be sent after your request is processed.

The person you have chosen as your agent can also submit the request for you. In that case, they must send a copy of your ID document to the Helpdesk or show it at the Guichet.lu reception desk.

Before contacting the Helpdesk or visiting the Guichet.lu reception desk, make sure you have one of the authentication products listed above. Your product must be operational (i.e. you must have activated it and must know your login details) so our teams can help you create your private eSpace.

Deadlines

You can create a digital power of attorney for a minimum duration of one month and a maximum duration of 12 months.

No reminder will be sent prior to the expiry of the digital power of attorney.

Creating the power of attorney alone will not allow the person you have chosen to be your agent to complete online procedures on your behalf. If you, as the principal, create the power of attorney yourself, the other person must first accept the request in order for the power of attorney to take effect.

The effective date therefore corresponds to the date on which your agent accepts the power of attorney.

You cannot select an effective date that is in the future.

The expiry date is always calculated:

  • starting from the date on which the power of attorney is created, not from the effective date;
  • based on the validity period selected when the power of attorney was created.

The person who creates the power of attorney – whether that is the principal or the agent – can choose the validity period.

As the principal, you can, at any time:

  • change the validity period, in accordance with the minimum and maximum duration of the power of attorney;
  • cancel the power of attorney.

You can perform both of these actions:

  • online through your MyGuichet.lu private eSpace;
  • in person at the Guichet.lu reception desk.

Your agent will receive an email notification (and a push notification if they use the MyGuichet.lu mobile app) if you change the validity period or cancel the power of attorney.

Your agent:

  • cannot change the validity period, even if they created the power of attorney themselves;
  • can cancel the power of attorney at any time.

You will receive an email notification (and a push notification if you use the MyGuichet.lu mobile app) if your agent cancels the power of attorney.

Creating a power of attorney

As the principal, you can create the power of attorney yourself or assign this task to the person you have chosen to be your agent.

Below you will find instructions on how to create the digital power of attorney yourself. If you prefer to assign this task to the person you have chosen as your agent, they can find all the information they need in the explanatory text for agents:

Agent: managing MyGuichet.lu procedures on behalf of another person

As the principal, you can create the digital power of attorney:

  • online through MyGuichet.lu; or
  • in person at the Guichet.lu reception desk.

To create the digital power of attorney through MyGuichet.lu (see 'Online services and forms'), you need the following information about the person you have chosen to be your agent:

To create the digital power of attorney in person at the Guichet.lu reception desk, you do not need to make an appointment. The person you have chosen to be your agent does not need to go with you to the Guichet.lu reception desk.

When creating the power of attorney in person, you must provide the following information:

  • about yourself:
    • your surname and first name;
    • your date and place of birth;
    • your 13-digit Luxembourg national identification number (Matricule);
    • the identifier of your private eSpace; and
  • about the person you have chosen to be your agent:

You must also have your identity card with you.

The staff member at the Guichet.lu reception desk will be able to use this information to create the digital power of attorney for you.

Whichever method you use to create the digital power of attorney, the person you have chosen to be your agent will receive an email notifying them that they have been sent a power of attorney. This email will automatically be sent to the email address your agent entered in their private eSpace.

Acceptance of a power of attorney

Creating the power of attorney alone will not allow the person you have chosen to be your agent to complete online procedures on your behalf. They must first accept the request through their private eSpace on MyGuichet.lu in order for the power of attorney to take effect.

You will receive an email notification (and a push notification if you use the MyGuichet.lu mobile app) when the agent has accepted the power of attorney.

After the agent accepts the request, the digital power of attorney will remain active during its validity period.

Rejection and cancellation of the power of attorney

If the other person does not want to complete online procedures on your behalf and does not want to serve as your agent, they can reject the request in their private eSpace on MyGuichet.lu.

You will receive an email notification (and a push notification if you use the MyGuichet.lu mobile app) if the other person rejects the power of attorney.

Once they reject the request, the same request cannot be re-sent. To try again, you must create a new power of attorney, either through MyGuichet.lu or in person at the Guichet.lu reception desk.

Both parties can cancel the digital power of attorney at any time. Additional information about cancellation is available under 'Deadlines › Expiry date'.

Expiry and extension

If the digital power of attorney is not extended or renewed, it will automatically expire at the end of the validi-ty period selected during its creation.

No reminder will be sent prior to the expiry of the digital power of attorney.

If the duration of the initial power of attorney was set at less than one year, you, as the principal, can extend the power of attorney by changing the validity period:

  • provided that this change is made before the expiry date; and
  • in accordance with the minimum and maximum duration of the power of attorney, which is always calculated starting from the initial date of creation.

The total duration of a power of attorney may never exceed one year.

Your agent cannot extend the power of attorney.

Renewal

The digital power of attorney on MyGuichet.lu automatically expires at the end date of the period of validity. If you wish to renew the power of attorney, you must create a new power of attorney (either on MyGuichet.lu or at the Guichet.lu reception desk).

Good to know

Ongoing procedures eligible for the power of attorney

Procedures that your agent has not submitted before the expiry of the power of attorney are saved in your private eSpace. After the power of attorney is extended or renewed, your agent can resume the procedures without losing the information that was already entered.

If there are procedures the government department is still processing when the power of attorney expires:

  • you can either continue the procedures on your own; or
  • one of the 2 parties can renew the power of attorney so your agent can continue.

Journal of powers of attorney

In the journal of powers of attorney (see 'Online services and forms') on MyGuichet.lu, you can:

  • view the list of people who currently have access to your private eSpace (i.e. active powers of attorney);
  • view all powers of attorney that have been rejected or cancelled, or that have expired;
  • download proof of power of attorney for all the active powers of attorney that authorise someone else to access your private eSpace.

Proof of power of attorney

Proof of power of attorney is an official document that:

  • certifies that the person you have chosen to be your agent is authorised to act on your behalf; and
  • is valid only for administrative procedures completed under the digital power of attorney on MyGuichet.lu;
  • cannot be used to prove power of attorney outside of MyGuichet.lu (e.g. in person at a government department or at a bank).

The proof of power of attorney contains a GouvCheck QR code that can be used to verify the authenticity of an official document issued in Luxembourg, free of charge and in real time.
