Guardian (agent): creating a digital power of attorney for a person placed under guardianship in Luxembourg
Last update
Summary:
As a guardian, you can create what is known as a 'digital power of attorney', which enables you to complete online procedures through MyGuichet.lu on behalf of the person under your guardianship.
This power of attorney allows you to log on to MyGuichet.lu with your own authentication product (e.g. your LuxTrust product) in order to access the private eSpace of the person under your guardianship. You thus assume the role of guardian agent.
To create the digital power of attorney, you must visit the Guichet.lu reception desk in person.
This text explains how you, as a guardian, can create a digital power of attorney in order to access the private eSpace of the person under your guardianship. Only guardianship orders issued by a Luxembourg court are accepted in connection with the digital power of attorney.
Who is concerned
Any natural person, whether they reside in Luxembourg or not, and who:
- is of legal age;
- is appointed guardian of an individual through a decision by a Luxembourg court; and
- has a 13-digit Luxembourg national identification number (Matricule).
In cases of guardianship of a minor, a digital power of attorney cannot be created even if the person has reached the minimum age to use MyGuichet.lu.
Preliminary steps
Setting up a private eSpace
Before the digital power of attorney can be created, both parties – that is, the guardian and the person under their guardianship – must each have a private eSpace on MyGuichet.lu.
When creating a private eSpace, a unique identifier, known as the eSpace identifier (also commonly referred to as the 'ID' or 'Espace-ID' in Luxembourgish) is assigned to each private eSpace. The eSpace identifiers of both parties must be indicated when setting up the power of attorney.
Difficulties accessing the private eSpace of the person under guardianship
The person who is under your guardianship created a MyGuichet.lu account before being placed under guardianship. However, they can no longer log in, for example because the authentication product they were using at the time no longer works or is no longer supported. They therefore have a private eSpace but cannot view the identifier assigned to it. In this situation, you may submit a request to receive the identifier of this person's eSpace.
You can submit your request:
- to the Guichet.lu Helpdesk using the contact form;
- in person at the Guichet.lu reception desk.
In your request, you must:
- state that you need the identifier of the eSpace of the person under your guardianship so you can create a digital power of attorney;
- provide:
- the 13-digit Luxembourg national identification number (Matricule) of the person under your guardianship; and
- the email address the identifier should be sent to.
In order for your application to be processed, you must also provide proof of:
- the identity of the person for whom you are the guardian; and
- that you are the guardian of the person concerned.
- Contact form
- Reception desk
If you submit your application via the contact form, the Helpdesk will contact you about the supporting documents you need to provide (as it is not possible to attach files directly to the contact form).
If you submit your application in person at the Guichet.lu reception desk, you must bring and present the following documents:
- a valid identity document of the person for whom you are the guardian;
- the original copy of the guardianship order.
After your request is processed, you will receive the identifier by email.
Even if you are submitting your request in person at the Guichet.lu reception desk, you will not receive the eSpace identifier right away. You must provide an email address to which the identifier will be sent after your request is processed.
Deadlines
You can create a digital power of attorney for a minimum duration of one month and a maximum duration of 12 months.
No reminder will be sent prior to the expiry of the digital power of attorney.
- Effective date
- Expiry date
Creating the power of attorney alone will not allow you to complete online procedures on behalf of the person under your guardianship. After you create the power of attorney at the Guichet.lu reception desk, you will need to accept it in your private eSpace in order for it to take effect.
The effective date therefore corresponds to the date on which you accept the power of attorney.
You cannot select an effective date that is in the future.
The expiry date is always calculated:
- starting from the date on which the power of attorney is created, not from the effective date;
- based on the validity period selected when the power of attorney was created.
You can choose the validity period when you set up the power of attorney.
How to proceed
Scope of the power of attorney and legal liability
The digital power of attorney on MyGuichet.lu is a generic power of attorney. Further details on the scope and legal liability can be found under guichet.lu/digital-power-of-attorney.
Creating a power of attorney
As a guardian, you may only create a digital power of attorney for the person under your guardianship in person, at the Guichet.lu reception desk.
You do not need to make an appointment. The person under your guardianship does not need to go with you to the Guichet.lu reception desk.
When creating the power of attorney in person, you must provide the following information:
- about yourself:
- your surname and first name;
- your date and place of birth;
- your 13-digit Luxembourg national identification number (Matricule);
- the identifier of your private eSpace; and
- about the person under your guardianship:
- their surname and first name;
- their date and place of birth;
- their national identification number (Matricule);
- the identifier of their private eSpace.
You must also have the following documents with you:
- your identity card;
- a copy of the identity card of the person under your guardianship;
- the original copy of the guardianship order.
The staff member at the Guichet.lu reception desk will be able to use this information to create the digital power of attorney for you.
You will then receive an email notifying you that you have received a power of attorney. This email will automatically be sent to the email address you entered in your private eSpace.
Acceptance and cancellation of a power of attorney
- Acceptance
- Cancellation
Creating the power of attorney alone will not allow you to complete online procedures on behalf of the person under your guardianship. You must first accept the request through your private eSpace on MyGuichet.lu in order for the power of attorney to take effect.
After it is accepted, the digital power of attorney will remain active for its validity period.
You can cancel the power of attorney at any time:
- online through your MyGuichet.lu private eSpace;
- in person at the Guichet.lu reception desk.
Expiry and renewal
The digital power of attorney on MyGuichet.lu automatically expires at the end date of the period of validity. If you wish to renew the power of attorney, you must create a new power of attorney at the Guichet.lu reception desk.
No reminder will be sent prior to the expiry of the digital power of attorney.
Good to know
Ongoing procedures eligible for the power of attorney
Procedures that you have not submitted before the expiry of the power of attorney are saved in the private eSpace of the person under your guardianship. After the power of attorney is renewed, you can resume the procedures without losing the information that was already entered.
If there are procedures the government department is still processing when the power of attorney expires, you can continue these procedures after renewing the power of attorney.
Journal of powers of attorney
In the journal of powers of attorney (see 'Online services and forms') on MyGuichet.lu, you can:
- view the list of people whose private eSpaces you currently have access to (i.e. active powers of attorney);
- view all powers of attorney that have been rejected or cancelled, or that have expired;
- download proof of power of attorney for:
- the active power of attorney that authorises you to access the private eSpace of the person under your guardianship;
- the powers of attorney that have expired or been cancelled.
Proof of power of attorney
Proof of power of attorney is an official document that:
- certifies that you are authorised to act on behalf of the person under your guardianship; and
- is valid only for administrative procedures completed under the digital power of attorney on MyGuichet.lu;
- cannot be used to prove power of attorney outside of MyGuichet.lu (e.g. in person at a government department or at a bank).
The proof of power of attorney contains a GouvCheck QR code that can be used to verify the authenticity of an official document issued in Luxembourg, free of charge and in real time.
