Scope of the digital power of attorney

Do you know anyone who needs help carrying out their administrative procedures online via MyGuichet.lu (for example, a family member or close friend)? Or are you yourself in a situation where you would like to entrust someone else with managing your administrative procedures online via MyGuichet.lu?

With the digital power of attorney (commonly referred to as 'procuration numérique' in French), the Ministry for Digitalisation, in collaboration with the Government IT Centre (Centre des technologies de l’information de l’État - CTIE), has introduced a secure and transparent solution that enables people to carry out administrative procedures online via MyGuichet.lu on behalf of another person.

The following roles exist within the digital power of attorney system on MyGuichet.lu:

  • the agent carries out administrative procedures online via MyGuichet.lu on behalf of another person;
  • the guardian agent carries out administrative procedures online via MyGuichet.lu on behalf of the person under their guardianship;
  • the principal entrusts another person with the management of their administrative procedures online via MyGuichet.lu.

Scope of the power of attorney and legal liability

The digital power of attorney on MyGuichet.lu is a generic power of attorney. It covers all past, present and future online services offered on the MyGuichet.lu platform that are eligible for the power of attorney.

You can view the full and up-to-date list of services eligible for the power of attorney in the services catalogue in your private eSpace (see 'Online services').

The generic power of attorney allows the agent to access:

The agent may thus, on behalf of their principal:

  • manage the online administrative procedures eligible for the power of attorney;
  • consult, download or delete documents and communications relating to online services eligible for the power of attorney that are sent electronically to the principal’s private eSpace;
  • consult, download or delete all documents sent electronically, following activation of the relevant eDelivery service, in the 'My messages' section (without being able to activate or deactivate the eDelivery services themselves);
  • consult and amend all information entered in the eSpace account profile (with the exception of identification details, which are read-only);
  • consult, download, add or delete documents in the 'My Documents' section.

A principal may have several agents at the same time. If this is the case, it is the responsibility of all parties concerned to consult with one another to avoid any conflicting actions.

Each agent can view all actions that their principal (or, where applicable, one of their agents):

  • has carried out within the scope of the power of attorney prior to the digital power of attorney coming into force;
  • carries out during the period of validity of the digital power of attorney.

It is currently not possible to amend the scope of the digital power of attorney on MyGuichet.lu, nor to select individually the actions that the agent may carry out via the principal’s private eSpace.

As long as the principal has a functioning authentication method, they:

  • retain access to their private eSpace at all times; and
  • may continue to carry out all the actions mentioned above.

Furthermore, they will receive an email notification (and a push notification if they use the MyGuichet.lu mobile app) when:

  • their agent has submitted a procedure that is eligible for the digital power of attorney and the status of that procedure changes;
  • a document or communication relating to an online service that is eligible for the power of attorney has been sent to their private eSpace.

As long as the principal is not under guardianship, they remain liable for any actions carried out by the agent on their behalf via their private eSpace on MyGuichet.lu.

If a public administration has valid grounds to believe that an action carried out on behalf of the principal was unlawful, the principal may in turn hold the agent liable. If this is successful, the agent is held liable for any damages incurred.
