Séjourner au Luxembourg en tant que salarié UE détaché par une entreprise située hors de l'Union européenne

L’entreprise établie hors de l'Union européenne (UE) doit demander une autorisation collective de détachement préalable de la Direction générale de l’immigration du ministère des Affaires intérieures pour pouvoir détacher ses salariés au Luxembourg.
Pour séjourner moins de 3 mois au Luxembourg durant leur détachement, les salariés détachés citoyens de l’UE n’ont aucune démarche à effectuer.
Pour séjourner plus de 3 mois, les citoyens de l’UE doivent effectuer :
- une déclaration d’arrivée auprès de leur nouvelle commune de résidence ; et
- y remplir une déclaration d’enregistrement.
Personnes concernées
Tout citoyen de l’UE ou d’un pays assimilé (Islande, Liechtenstein, Norvège ou Suisse) détaché au Luxembourg par un prestataire de services établi hors de l'UE peut travailler et / ou séjourner au Luxembourg durant son détachement sans aucune autorisation de séjour préalable.
Conditions préalables
Le détachement temporaire doit se faire dans le cadre d'un contrat (de prestation de services) conclu entre l'entreprise d'envoi et le destinataire de la prestation de services exerçant son activité au Luxembourg.
Le salarié détaché est tout salarié :
- travaillant habituellement à l'étranger ;
- qui exécute son travail sur le territoire du Grand-Duché du Luxembourg ;
- pendant la durée déterminée de la prestation de services précise pour laquelle le contrat de prestation de services a été conclu.
Ainsi, le salarié détaché est envoyé au Luxembourg pour une durée limitée avec maintien d'un lien de subordination avec l'entreprise qui le détache.
La durée limitée s'apprécie :
- en fonction de la durée, de la fréquence, de la périodicité et de la continuité de la prestation de services ; et
- en relation avec la nature de l'activité qui fait l'objet du détachement.
Démarches préalables
L'entreprise établie hors de l’UE doit au préalable disposer d'une autorisation d'établissement.
Le salarié détaché citoyen de l’UE n’a aucune démarche préalable à effectuer.
Modalités pratiques
Séjour de moins de 90 jours
Pour un séjour de moins de 3 mois, le citoyen UE n’a aucune formalité particulière à accomplir.
Il doit simplement être en possession d’une carte d’identité nationale ou d’un passeport en cours de validité.
Il peut, s’il le souhaite, déclarer son arrivée auprès de sa commune de résidence et demander une attestation d’enregistrement (Pdf, 117 Ko).
Séjour de plus de 90 jours
Pour un séjour de plus de 3 mois le citoyen de l’UE doit effectuer, dans les 8 jours de son arrivée au Luxembourg, une déclaration d’arrivée auprès de sa nouvelle commune de résidence, en présentant notamment :
- une carte d’identité nationale ou un passeport en cours de validité ;
- le certificat A1 (E101) transmis par son employeur avant le détachement ;
- le cas échéant, la déclaration de départ établie par l’administration communale du précédent lieu de résidence.
Dans les 90 jours de son arrivée au Luxembourg, le citoyen UE doit remplir une déclaration d’enregistrement (Pdf, 117 Ko) auprès de l’administration communale de sa résidence.
La déclaration d’enregistrement doit être accompagnée des documents suivants :
- une copie de la carte d’identité nationale ou du passeport en cours de validité ;
- une copie du contrat de travail ;
- une copie du certificat A1 (E101) transmis par l’employeur.
Perte, vol ou détérioration de l'attestation
En cas de perte, vol ou détérioration de l'attestation d'enregistrement, une procédure spécifique est à effectuer.
