Summary:

Any employer must set up or affiliate with an occupational health service in order to ensure the safety and health of their employees in all aspects related to work.

If you are an employer, you must register with an occupational health service or, failing that, set up your own in-house occupational health service.

The main occupational health services are:

  • the Industrial Occupational Health Service (Service de santé au travail de l’industrie - STI);
  • the Occupational Health Association for the Tertiary and the Financial Sector (Association pour la santé au travail des secteurs tertiaire et financier - ASTF);
  • the Multi-sector Occupational Health Service (Service de santé au travail multisectoriel - STM).

The main role of occupational health services is to advise or assist you in your procedures related to health, ergonomics, hygiene and safety at work.

The purpose of this legal obligation is to ensure the health and safety of your employees in all aspects related to work.

Who is concerned

Any employer must:

  • register with an occupational health service; or
  • set up their own health service within their company; or
  • join forces with other employers in a business association that organises an inter-company occupational health service for all members of the association.

Large businesses must set up their own occupational health service if they employ:

  • between 3,000 and 5,000 staff, of which at least 100 carry out hazardous jobs; or
  • more than 5,000 staff.

The main health services, organised according to business sectors, are:

  • Industrial Occupational Health Service (STI) for businesses which are members of:
    • the Fedil - Business Federation; or
    • the Federation of Luxembourg Construction and Civil Engineering Companies (Fédération des entreprises de construction et de génie civil);
  • Occupational Health Association for the Tertiary and the Financial Sector (Association pour la Santé au travail des secteurs Tertiaire et Financier - ASTF) for companies in the tertiary and financial sectors that are a member of:
  • Multi-sector Occupational Health Service (STM) for businesses in all other sectors.

Costs

When you pay your social security contributions, the Joint Social Security Centre (Centre commun de la sécurité sociale - CCSS) directly deducts the contributions that must be paid to the occupational health service.

The contribution rate you are liable for varies depending on your sector of activity.

Setting up your own occupational health service or registration with an occupational health service

If you're setting up your own occupational health service, the service must:

  • be a specific service within your company; and
  • have at least one qualified occupational health practitioner working on a full-time basis.
