Staying in Luxembourg for less than 90 days after a long stay

Third-country nationals who wish to come to Luxembourg for a short stay – i.e. less than 90 days – after their long-stay authorisation has expired must register their short stay in the Entry/Exit System (EES).

The Entry/Exit System (EES) is an automated electronic information system that is used to register entries and exits of third-country nationals who cross Schengen Area Member States' external borders for a short stay in a Member State.

Schengen Area Member States: Austria, Belgium, Bulgaria, Croatia, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Iceland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Netherlands, Norway, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, and Switzerland.

Article 14(8) of Regulation (EU) 2017/2226 provides that any third-country national who wishes to remain in/(re-)enter a Schengen Area Member State for a short stay, following a long stay in one of those States, must be registered in the Entry/Exit System (EES).

As such, following a long stay, third-country nationals who do not require a visa to enter the Schengen Area may apply to the General Department of Immigration (Direction générale de l’immigration) to register a short stay in the EES system.

Otherwise, the short stay must be registered at the border checkpoint on leaving the Schengen Area. Registering at a border checkpoint may be a lengthy process, due to the additional checks that need to be made on the long-stay documents required for registration.

It is therefore advisable to submit the application beforehand following the procedure below, or to arrive at the airport well in advance with all of the required supporting documents.

Who is concerned

Nationals of

Third-country nationals who wish to stay in Luxembourg for a short stay following the expiry of their long-stay authorisation, provided that they:

  • are exempt from visa requirements; and
  • possess a residence document (titre de séjour), a residence permit (carte de séjour), or a long-stay visa that was issued by Luxembourg or another Schengen Area Member State, and which is due to expire within one month, or which has already expired; and
  • are in Luxembourg when their long-stay authorisation expires.

Third-country nationals who:

  • wish to stay in the Schengen Area for a short stay after their long-stay authorisation has expired; and
  • are subject to visa requirements.

In this case, third-country nationals must apply for a type-C visa from the Passport, Visa and Legalisation Office (Bureau des passeports, visas et légalisations). If the type-C visa is granted, the Passport, Visa and Legalisation Office will create a file for the third-country national in the EES system.

'Short stay' and 'long stay' defined

In the Schengen Area, a short stay is a stay in any of the Schengen Area Member States that lasts no more than 90 days in any 180-day period. This rule applies to third-country nationals who wish to enter the Schengen Area as tourists, or to visit family or attend business meetings, and who do not plan to take up permanent residence or engage in a regular professional activity in a Schengen Area Member State. The duration of the short stay (i.e. 90 days) is cumulative, which means that it is the aggregate duration of the third-country national's stays in all Schengen Area Member States.

A long stay is a stay in a Schengen Area Member State that lasts more than 90 days. Long stays require a long-stay visa, a residence document (titre de séjour), or a residence permit (carte de séjour), which may be issued to third-country nationals who are planning to study or work in a Schengen Area Member State.

Prerequisites

Third-country nationals who do not require a visa to enter the Schengen Area must possess:

  • a valid passport;
  • a residence document (titre de séjour), or a residence permit (carte de séjour), or a long-stay visa issued by Luxembourg, or another Schengen Area Member State, which is due to expire within one month, or which has already expired; or
  • in the absence of one of the documents mentioned above, official proof that the third-country national did possess a residence document (titre de séjour), or a residence permit (carte de séjour), or a long-stay visa. 'Official proof' can be a document that:
    • was issued by a competent authority; and
    • shows information about the residence document, residence permit or long-stay visa, including its expiry date.

Costs

Applying to register in the Entry/Exit System (EES) is free.

How to proceed

Filing an application

Your application to register a short stay in the EES must be filed with the General Department of Immigration.

The application can be filed:

  • online via MyGuichet.lu. You can choose between the procedure:
    • with authentication using:
      • a LuxTrust product; or
      • an electronic identity card (eID); or
    • without authentication;
  • by post using the required form, which must be completed and sent to the following address:

    L-2017 Luxembourg.

Supporting documents

The following documents must be included with your application (regardless of whether you file your application online or by post):

  • a full copy of your valid passport (all of the pages);
  • if issued by another Member State:
    • a copy of your residence document (titre de séjour); or
    • a copy of your residence permit (carte de séjour); or
    • a copy of your long-stay visa; or
    • in the absence of one of the documents mentioned above, official proof that you did possess one of those documents.

Eligibility check

Once it has received your application and supporting documents, the General Department of Immigration will run a check to confirm your eligibility.

Confirmation and registration in the EES system

Once your eligibility is confirmed, you will be invited to the General Department of Immigration to complete your file and record your biometric data.

The General Department of Immigration will then register your entry for a short stay in the EES system.
