Persons who wish to develop their professional skills through training may benefit from leave in order to:
- participate in training courses;
- prepare for and take exams;
- write a thesis;
- complete any work in relation to an eligible training course.
Who is concerned
The following may benefit from individual training leave:
- the employee:
- who holds a work position in the private sector that is located in Luxembourg (regardless of their place of residence);
- who has an employment contract with a business or association legally established and active in Luxembourg;
- whose length of service is at least 6 months with the employer at the time of the request for leave.
- the self-employed worker (or liberal profession):
- who has been registered for at least 2 years with the Luxembourg social security office;
- who has their professional domicile in Luxembourg;
- who works in Luxembourg.
- all persons:
- who have an apprenticeship contract;
- who are preparing for and competing in an international, European or Luxembourgish championship of trades.
The employer must give their opinion following the employee's application.
Applicants can attend training courses offered in Luxembourg and abroad by:
- public or private schools whose activities and certificates are recognised by the public authorities;
- the professional chambers;
- the communes;
- private foundations, natural persons and associations that are accredited by the Minister of Education, Children and Youth;
- ministries, administrations and public establishments.
The training does not have to be directly related to the individual's profession. The courses can take place during working hours, evenings or at the weekend.
Training courses offered and co-financed by other means are not eligible, such as:
The request must be submitted 2 months before the start of the leave requested.
How to proceed
Amount of training leave
Each worker has 80 days of leave at their disposal for individual training during their professional career. These days can be taken in several stages provided the following conditions are respected:
- maximum 20 days over a period of 2 years;
- minimum 1 day at a time.
The worker may recover 1/3 of the time devoted to the training as individual training leave:
- the number of hours of training is divided by 8 hours (for full-time employees) such as to obtain the number of days of training;
- the number of days of training is then divided by 3 to obtain the number of days of training leave. This number is rounded down to the nearest whole number if necessary.
A full-time employee had 26 hours of training.
- 26 / 8 hours = 3.25 days of training
- 3.25 / 3 = 1.083333 days of training leave (to be rounded down to the nearest whole number)
A 26-hour training course gives rise to 1 day of training leave.
Training leave is considered as an effective period of work and as such:
- may not be deducted from the annual leave;
- must be taken into consideration when calculating the days of annual leave due.
During their training leave, the employee continues to benefit from the provisions regarding labour protection and social security.
For part-time employees, days of training leave are calculated in proportion to their effective working time.
Request for training leave for salaried workers
Submitting the application for training leave
Employees must fill in the first part of the application for training leave, and then submit the form to their employer.
Employers must fill in the section of the form to be completed by them, stating their opinion and, if it is unfavourable, their reasons.
- may not refuse the application for training leave;
- may express a negative opinion.
In case of a negative opinion, the leave can be reported:
- once only within a maximum period of one year;
- if the employee's absence is likely to have a negative impact on:
- the proper operation of the company; or
- the annual leave holiday planning of the company's employees.
The employee then sends the duly completed and signed form to the Department of Vocational Training (Service de la formation professionnelle) at the Ministry of Education, Children and Youth (Ministère de l'Education nationale, de l'Enfance et de la Jeunesse - MENJE).
The application must be accompanied by the following documents:
Remuneration of the employee
During the leave, the employer advances the employee a compensatory allowance. This allowance:
- is equal to the average daily wage;
- cannot exceed 4 times the social minimum wage for unskilled workers.
Application for training leave for self-employed workers
Submitting the application
The self-employed person can submit their application for training leave:
- using the online assistant on MyGuichet.lu with their LuxTrust certificate;
- by post by sending the application form to the Department of Vocational Training at the MENJE.
Applications must be accompanied by:
Compensation for self-employed workers
Self-employed workers (or liberal professions) have the right to financial compensation which is paid directly by the state. The allowance:
- is determined based on the income used, for the past financial year, as the earnings base subject to contributions to the pension fund;
- cannot exceed 4 times the social minimum wage for unskilled workers.
Time frame for a response
Normally, the applicant and their employer receive a response to their request at least 2 weeks before the leave is due to start.
Exceptions to the deadlines may be granted if the applicant is required to attend an examination. In such a case, however, it is in the interest of the person concerned to submit their application as soon they become aware of the date or dates of the examination.
Persons who have completed the training must:
- have the training organisation provide them with a certificate, issued in triplicate, proving that they used the leave for the stated purpose.
- in the case of employees, immediately give 2 copies of the certificate to their employer.
The employer / self-employed person / person exercising a liberal profession must make a declaration of reimbursement:
- online with MyGuichet.lu using a LuxTrust certificate;
- by post, by;
The declaration must be accompanied by:
- the training participation certificates;
- a copy of the ministerial approval;
- for employers:
- a copy of the salary slips for the corresponding period;
- a certificate from the employer stating the precise dates of the training leave taken;
- a copy of the letter from the Joint Social Security Centre indicating the rate of contribution to the Employers' Mutual Insurance Scheme; or
- for self-employed workers / liberal professions: the income certificate used for the last tax year as a contribution base for pension insurance.
The employer receives the amount of the compensatory allowance as well as the employer's share of social security contributions.
In the event of inaccurate or incomplete declarations, the beneficiary must:
- immediately return the allowances received;
- pay interest at the legal rate for the period ranging from the day the allowances were paid out until the day they were reimbursed.
