Declaring tattoo studios and establishments providing public tanning appliances

Summary:

You must declare all tattooing activities and/or the provision of tanning equipment. You can do so via MyGuichet.lu.

Anyone providing services that include tanning or tattooing techniques must declare the opening, closure or modification of their studio/establishment to the Health Directorate (Direction de la Santé).

These declarations concern:

  • tattoo studios;
  • establishments providing public tanning appliances.

Declarations must be made online via MyGuichet.lu.

To obtain the requested authorisation, the declarant and their staff must have followed, as applicable:

  • specific training on hygiene and health conditions; or
  • training on hygiene conditions and protection against ultraviolet radiations.

Who is concerned

Any owner of a tattoo studio or an establishment providing tanning appliances to the public.

That means that the following activities are concerned:

This does not apply to the following:

  • health professionals if they only carry out healthcare acts;
  • anyone who holds a business permit (autorisation d’établissement) as a jeweller, issued by the General Directorate for SME, Craft and Retail (Direction générale des PME, artisanat et commerce), when piercing earlobes using an ear-piercing gun.

Prerequisites

Providers of tattooing services must undergo at least 21 hours of training in health and hygiene. This training must have been carried out at:

  • a training establishment authorised to provide training in Luxembourg; or
  • an establishment recognised by the competent authorities of the issuing State for training courses attended in another EU Member State.

Anyone making UV tanning appliances available for use by the public must have attended a training course lasting at least 8 hours on conditions for hygiene and protection against ultraviolet radiations. This training must have been carried out at:

  • a training establishment authorised to provide training in Luxembourg; or
  • an establishment recognised by the competent authorities of the issuing State for training courses attended in another EU Member State.

Deadlines

You must declare your activity one month before the start of the activity.

Modifying or ceasing the activity must be declared within one month of the change in situation occurring or cessation of activity.

Costs

There is no charge for making the declaration.

How to proceed

Submitting the application

Carrying out the procedure online

You make your declaration online via MyGuichet.lu. This is a procedure requiring authentication with a LuxTrust product or an electronic ID card (eID).

Connect to your business eSpace MyGuichet.lu to declare the opening, change or cessation of activities of your studio/establishment.

How to create a business eSpace on MyGuichet.lu

There are 2 possible scenarios:

  1. You are a new user of MyGuichet.lu. You must:
    • first register on MyGuichet.lu; and
    • then create a business eSpace.
  2. You already have a private eSpace on MyGuichet.lu. You can directly create a business eSpace without having to register again.

There you provide:

  • the full address of your establishment;
  • the date of the declaration;
  • your phone number and email address;
  • your 13-digit national identification number (matricule).

You then select the type of procedure, namely notification of commencing an activity, modification or cessation of the activity.

Declaring a tattoo studio

You must provide information:

  • about you:
    • your surname and first name;
    • your email address and telephone number;
  • about:
    • the tattoo studio:
      • the date the activity will commence;
      • the name of the studio;
      • the name and first name of the manager;
      • the address of the studio;
      • the studio's website;
      • the surname, first name, email address and telephone number of the manager/person in charge of the studio;
    • the activities carried out at the studio: tattooing/permanent make-up, body piercing, cutting, branding;
    • the people included on the notification: their surnames and first names.

At the end of the procedure, you must electronically sign the document that lists all the information entered.

Declaring tanning appliances made available to the public

You must provide information:

  • about you:
    • your surname and first name;
    • your email address and telephone number;
    • the name of your establishment's registered office;
    • the address of the registered office in Luxembourg;
  • about:
    • the place(s) of operation:
      • the name(s) of the establishment(s);
      • the address(es) of the place(s) of operation;
    • UV appliances:
      • manufacturers;
        • models;
        • serial numbers;
        • UV ratings;
        • total actual radiation;
        • approved inspection bodies;
        • dates of last inspections;
    • the staff:
      • their names and first names;
      • their training, with date(s).

At the end of the procedure, you must electronically sign the document that lists all the information entered.

Particular points for modifying or ceasing the activity of a studio/establishment

If you wish to modify your initial declaration or declare the cessation of an activity you must:

  • log on to your business eSpace MyGuichet.lu;
  • select the procedure for the initial declaration entered when your studio/establishment was opened;
  • make a copy of the procedure and then select 'Modification' (Modification) or 'Cessation of activity' (Cessation d’activité).

Specifications for artists working in the tattoo industry and who do not have a Luxembourg national identification number (matricule)

You must make your declaration online via MyGuichet.lu. This is a procedure without authentication.

After having sent your application, you will receive a notification email.

If you do not receive an email after having submitted your application, you should check your email spam folder.

Supporting documents

For each person declared, you must attach a copy of either the attestation of attending a training course on hygiene or a copy of the diploma awarded.

The administration may ask for additional supporting documents.

The administration's response

Your application is sent to the Health Directorate.

An inspector from the Health Inspection checks the information provided and either accepts or refuses the application.

If the application is accepted, you receive:

  • a communication with the corresponding certificate, in the case of an initial application;
  • a communication including notification of acceptance.

Sanctions

If you don't declare your activity, you risk a prison sentence and/or a fine.

Appeal

A negative decision in response to a declaration is an administrative decision against which the usual means of appeal (non-contentious appeal, judicial appeal) may be pursued, provided the legal deadlines are complied with.

It is also possible to lodge an appeal with the Ombudsman.
