Application for document approval (air operations)

Operators that hold an Air Operator Certificate (AOC) must submit their operating manual (OM) to the competent authority for prior approval. This approval is required when amendments to the manual in question apply to procedures pertaining to the list of items that require prior approval (see requirement ORO.GEN.130 of Annex III of Regulation (EU) No 965/2012).
The Minimum Equipment Lists (MEL) in Part B of the operating manual require prior approval for every amendment, as stipulated in paragraph ORO.MLR.105 of Annex III of Regulation (EU) No 965/2012.
In addition, the key management system processes must be described and documented in accordance with requirement ORO.GEN.200 of Annex III of Regulation (EU) No 965/2012. This description may appear:
- either in the operating manual (OMA);
- or in a specific manual:
- Organisation Management Manual (OMM);
- Management System Manual (MSM);
- Safety Management Manual (SMM);
- Compliance Monitoring Manual (CMM).
When amendments to the manual in question apply to procedures pertaining to the list of items that require prior approval (see requirement ORO.GEN.130 of Annex III of Regulation (EU) No 965/2012), they must be submitted for approval in accordance with this procedure.
The Directorate of Civil Aviation (Direction de l'Aviation Civile – DAC) is the competent authority in Luxembourg.
Who is concerned
Air operators concerned
Commercial air operators that hold an commercial air transport certificate (CAT or AOC) issued by the DAC.
Reminder: an aircraft operator is any natural or legal person that operates or proposes to operate one or more aircraft.
Prerequisites
The content of the operating manual must meet the requirements of Regulation (EU) No 965/2012.
Deadlines
Amendments to the manual requiring prior approval must be submitted to the DAC 30 days before the desired date of implementation.
Costs
According to the terms of the Grand Ducal regulation of 19 November 2019.
How to proceed
Filing an application/declaration
Applicants must duly complete and sign the form "Application for document approval DAC-OPS-600".
The application must be sent to the following email address: ops@av.etat.lu.
Supporting documents
The application must be accompanied by the following:
- an electronic copy of the manual in question;
- proof that management of change has been implemented.
Application processing time
The manual submitted for approval is reviewed within 30 days of receipt of the application.
