If you operate as a credit intermediary, you must be registered on the list of professionals who are authorised to engage in this activity.

A consumer credit intermediary is a legal or natural person who may be involved in a consumer credit agreement. When they are involved in such agreements, it must be:

  • as part of their commercial, industrial, craft or self-employed activity; and
  • for financial compensation.

They may offer their services either as their primary activity or on an ancillary basis (e.g. a car dealership).

As a credit intermediary, you must file an application with the Directorate for Consumer Protection (Direction de la protection des consommateurs) to be registered on the list of authorised credit intermediaries.

Prerequisites

Ministerial authorisation

As a credit intermediary, you must obtain all of the required ministerial authorisations, namely:

  • an authorisation issued by the Ministry of Finance (Ministère des Finances), if you work in the financial sector;
  • an authorisation issued by the Ministry of the Economy (Ministère de l’Économie), if you work primarily in the commercial or craft sector and only act as a credit intermediary on an ancillary basis.

Setting up a business eSpace

To apply to be registered on the list of authorised credit intermediaries, you must have a business eSpace.

How to create a business eSpace on MyGuichet.lu

There are 2 possible scenarios:

  1. You are a new user of MyGuichet.lu. You must:
    • first register on MyGuichet.lu; and
    • then create a business eSpace.
  2. You already have a private eSpace on MyGuichet.lu. You can directly create a business eSpace without having to register again.

How to proceed

Filing an application

Your application to be registered on the list of authorised consumer credit intermediaries must be filed online via MyGuichet.lu (see 'Online services and forms'), from your business eSpace.

This procedure requires:

You may:

  • complete this procedure yourself as a credit intermediary; or
  • have it done by an agent.

In your registration application, you must specify:

  • the identity of the lender you are representing or working with; and
  • the lender's address.

If you are working with another consumer credit intermediary, you must specify their identity and address.

Supporting documents

The following supporting documents must be included with your application:

  • a copy of the agreement binding you to the lender;
  • a copy of your power of attorney if an agent is completing the procedure on your behalf;
  • a document listing the persons empowered to act on behalf of your enterprise, if the person filing the application does not have these powers.

Amendments or deregistration

You may also complete the following procedures online via MyGuichet.lu (see 'Online services and forms'):

  • request an amendment to the information appearing on the list of authorised credit intermediaries;
  • request that you be deregistered from the list of authorised credit intermediaries.
