Applying for a compensation for non-pecuniary damage following an accident or an occupational disease that occurred on or after 1 January 2011

A relative of an insured person who died as a result of an accident at work, a commuting accident, or an occupational illness may be eligible for compensation for non-pecuniary damage. Interested parties must send their request to the Accident Insurance Association (Association d'assurance accident - AAA). Compensation consists of a lump sum payment.

Who is concerned

Persons related to the insured who can claim compensation for their non-pecuniary damage are:

  • the surviving spouse or partner;
  • legitimate, natural or adoptive children;
  • the father and mother;
  • any other person who has lived in a domestic community with the insured for at least 3 years at the time of death.

Prerequisites

The work, commuting or school accident, or the occupational illness must have been declared beforehand.

Benefits relating to the work, commuting or school accident must have been declared beforehand. Additionally, the insured must have their occupational illness medically certified.

Deadlines

The beneficiaries must send their application to the AAA within 3 years from the death of the insured.

How to proceed

Spouse/partner and children of the insured

The spouse or partner and the children of the deceased insured are each entitled to a fixed benefit of EUR 3,649 at the cost of living index 100.

Father and mother of the insured

The father and mother of the deceased insured are each entitled to a fixed benefit of EUR 2,189 at the cost of living index 100.

Anyone who has lived in a domestic community with the insured

Any other person who has lived in a domestic community for at least 3 years with the insured person at the time of their death is entitled to a fixed benefit of EUR 1,459 at the cost of living index 100.
