Reporting a school/extracurricular accident

Summary:
Any school or extracurricular accident suffered by a schoolchild, pupil or student in the course of school education or during an extracurricular activity must be reported to the Accident Insurance Association (Association d’assurance accident - AAA) so that the victim can receive benefits.
The mayor or the head of the educational establishment or, failing this, their delegate or the representative of the Luxembourg body which organised the activity in question must declare any accident which:
- occurred in an early education establishment, preschool, school or university, including during extracurricular activities of those establishments;
- concerns a schoolchild, pupil or student.
Schoolchildren, pupils or students who reside in Luxembourg but attend an early education establishment, a preschool, school or university abroad are also covered by the Accident Insurance Association (AAA) against school accidents.
The declaration must be sent to the Accident Insurance Association. This can be done online via MyGuichet.lu.
Except in exceptional and duly justified circumstances, an insured person who suffers a school accident must immediately notify a member of staff who organised or supervised the insured activity.
Who is concerned
Schoolchildren, pupils or students who are victims of an accident in an early education establishment, a preschool, school or university, including during extracurricular activities.
The declaration must be made by:
- the mayor of the commune concerned;
- the head of school;
- a representative of the latter; or
- the representative of the Luxembourg organisation that organised the activity.
Prerequisites
School or extracurricular accident
A school accident is an accident that:
- happened in the context of school education or during an extracurricular activity; and
- caused an injury.
If the cause of the accident is unknown and the Accident Insurance Association (AAA) refuses to cover the accident, then the AAA must prove that the damage had an origin unrelated to the insured activity.
Commuting accident
The insured person is the victim a commuting accident if it occurs:
- on the outward or return journey between:
- their usual place of residence, i.e. their main residence, their regularly used secondary residence or any other place where the insured person usually goes for family reasons; and
- the educational establishment or the location of the extracurricular activity;
- their usual place of residence, i.e. their main residence, their regularly used secondary residence or any other place where the insured person usually goes for family reasons; and
- between the educational establishment or the location of the extracurricular activity and the place where the insured person usually has a meal;
- on the usual and most direct route.
The insured person will not be covered if the accident occurs:
- due to their own gross misconduct.
Example: violations of the highway code; - during a trip interrupted or diverted for reasons dictated by personal interest and independently of the insured activity.
Note that the journey is insured from 'door to door', that is to say, from the moment the person leaves their home until they enter the school building.
It should be noted that pupils and students benefit from compensation for material damage to a motor vehicle only if they have not been able to use public transport for serious reasons beyond their control.
Deadlines
The declaration must be sent as soon as possible.
If no declaration is sent to the AAA, the victim of an accident may lodge a claim with the AAA within one year of the day after the accident.

Accidents are to be declared by:
- the mayor or the head of an educational establishment, or their representative (depending on whether it is a primary school or another type of establishment), for accidents involving schoolchildren, pupils or students in an educational establishment in Luxembourg;
- the representative of the Luxembourg body organising an activity, when the accident occurs during an extracurricular activity;
- the head, or their representative, of the department, administration, institution or association that organised the activity.

The declaration can be submitted:
- online via MyGuichet.lu. This procedure requires authentication; or
- via a PDF form to be sent to the AAA:
- by email to declaration.aaa@secu.lu; or

The declaration must contain all the required information.
Complaint
If a declaration is not sent to the AAA, the victim of the accident may file a claim with the AAA.
Before reaching a decision, the AAA requests a statement of position from the person who was required to file the accident report.
Benefits related to school / extracurricular accidents
If the accident is covered by the AAA, the interested party can claim the following benefits:
- compensation for material damages to motor vehicles;
- compensation for incidental damages to property;
- compensation for damages to dental crowns, prostheses, orthoses or epitheses which the insured was wearing/carrying at the moment of the accident;
- coverage of:
- benefits in kind consisting in the coverage of health care expenses related to a school/extracurricular accident;
- benefits in cash in the event of total incapacity for work, for the first 78 weeks, corresponding to the payment of the insured party's salary and other benefits during the period of incapacity for work;
- benefit from:
- a full pension in case of a total work incapacity under certain conditions;
- a partial pension in the event of partial work incapacity with loss of salary under certain conditions;
- compensation for non-patrimonial damages.
If the insured person dies as a result of a recognised school accident, rightful claimants may apply for the following benefits:
