Applying for compensation or the review of compensation for non-patrimonial damages as an insured victim of an accident or an occupational disease that occurred on or after 1 January 2011

When a person is incapacitated due to an accident at work, a commuting accident or because of an occupational disease, he or she may claim compensation for non-patrimonial damages from the Accident Insurance Association (Association assurance accident - AAA), depending on the case and under certain conditions.
These allowances cover:
- compensation for physiological injury or discomfort;
- compensation for physical pain suffered prior to consolidation;
- compensation for aesthetic damage.
Who is concerned
This applies to any person who is affiliated and insured in Luxembourg:
- victim of an accident or an occupational disease;
- with a permanent total or partial incapacity for work due to said accident or occupational disease;
- whose injuries are consolidated.
Prerequisites
Compensation for physiological harm and discomfort
The insured must have suffered:
- physical effects;
- in connection with the accident or the occupational disease;
- that make all professional and private activities more difficult;
- decreasing the insured's value on the labour market;
- diminishing their quality of life, caused in particular by the difficulty, or even the impossibility of engaging in certain activities, of leisure or other, or;
- decreasing life expectancy.
Compensation for physical pain endured
The insured must have suffered:
- physical effects endured until consolidation;
- in connection with:
- the accident or occupational disease ; or
- the pain caused by the surgical and therapeutic treatments that the healing of the injuries required.
Compensation for aesthetic damage
The insured must have suffered effects that caused an anatomical injury resulting in:
- an alteration of how they are perceived by others;
- an alteration of their self-image.
Preliminary steps
The work, commuting orschool accident, or the occupational disease must have been declared forehand.
The Social Security Medical Board:
- sets the permanent partial disability rate to assess the amount of compensation for physiological injury or discomfort;
- concretely assesses the physical pain endured in relation to:
- the type of injury;
- the severity of the injury;
- the medical situation of the insured and its evolution;
- the perception of pain;
- then gives an opinion on the amount of the indemnity on the basis of a scale taking into account the severity of the damage.
To determine the degree of suffering from physical pain, the scale has 7 levels, ranging from 'very mild' to 'very significant'; - assesses the aesthetic damage by examining the insured in order to concretely evaluate their situation.
The Medical Board assesses the importance of the aesthetic prejudice according to:
- the consequences of the injury suffered.
Example: location and appearance of scars and possible disabilites; - the insured's age;
- an assessment scale for the amount of compensation.
The assessment scale of the aesthetic damage comprises 7 levels ranging from 'very minor' to 'very significant'.
Deadlines
The insured person must submit their application form to the AAA within 3 years of the stabilisation of their condition or professional retraining.
After the expiry of this 3-year period, the claim is only receivable if the insured person:
- proves that the consequences of the accident, in terms of the victim's working capacity, could only be ascertained later;
- was physically unable to make a request.
How to proceed
Compensation for physiological harm and discomfort
The insured receives the compensation in the form of monthly payments. However, when the degree of permanent partial disability is less than or equal to 20 %, the compensation is paid as a lump sum.
The compensation is adjusted to the cost of living and is not subject to tax or social contributions.
Compensation for physical pain and aesthetic damage
The insured receives their compensation in the form of a flat rate payment.
The amount of the flat rate awarded depends on the magnitude of the recorded harm.
It should be noted that the insured can only receive compensation for physical pain endured or for aesthetic damage in case the insured suffers irreversible consequences, that is to say only if the insured presents a rate of permanent partial incapacity.
Both types of compensation are not subject to any tax or social contributions.
Compensation review
The insured can request the review of the amount of compensation using a form (French, Pdf, 758 Kb) if they experience a worsening of the consequences of the accident or the occupational disease after the determination and payment of the compensation for non-patrimonial damages.
A slight worsening or temporary worsening of the after-effects does not warrant a review.
However, the new degree of permanent partial disability must be 10 % higher than the initial degree of disability, and the worsening must be permanent in order for the new degree of permanent disability to be assessed by the Social Security Medical Board.
Appeal
