Alerting the Office for Whistleblowers

Whistleblowers who report breaches of legal rules are protected against all forms of retaliation.

A uniform European legal framework has been created to protect whistleblowers when they report internally, externally or publicly disclose information obtained in a professional context, in accordance with the applicable legal provisions.

The main tasks of the Office for Whistleblowers are:

  • to inform and help anyone wishing to make a report. It explains the procedures to be followed;
  • to gather information on any non-compliance with the establishment of internal reporting channels.

The Office for Whistleblowers (hereinafter referred to as the 'Office'), in collaboration with the Government IT Centre, has developed an online assistant on MyGuichet.lu that will enable these 2 tasks to be carried out.

Who is concerned

Anyone who wants:

  • to obtain information and assistance for internal or external reporting, or public disclosure; or
  • to provide the Office with information on any non-compliance with the establishment of internal reporting channels.

Please note: legal entities in the private and public sectors are required to set up internal reporting channels and procedures and follow-up measures.

How to proceed

Filing an application

You can contact the Office for Whistleblowers in Luxembourgish, French, German or English:

  • via the 'Whistleblower' procedure without authentication on the secure MyGuichet.lu platform;
  • via email to: info@osig.lu;
  • by post to the postal address of the Office for Whistleblowers:

The secure MyGuichet.lu platform is to be preferred insofar as this channel best guarantees the requirements of independence and autonomy for the receipt and processing of requests received in accordance with the Law of 16 May 2023 transposing Directive (EU) 2019/1937 of the European Parliament and of the Council of 23 October 2019 on the protection of persons who report breaches of Union law.

You must provide the following information in your request:

  • breaches of legal provisions that you wish to report or information about failures to establish internal reporting channels that you wish to refer to the Office;
  • if possible, the entities or natural persons involved in the events described and their contact details;
  • a contact email address. This email address is required to enable you to provide further information.

Please note: an entity can be any company, organisation or public body involved in, affected by, or simply through which you have become aware of a breach of law in a professional context.

Any processing of personal data carried out under the law of 16 May 2023 is carried out in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.

As a public authority processing personal data, the Office is bound to respect the obligations incumbent on it in its capacity as a data controller.

Once you have submitted your request via MyGuichet.lu, you will receive an email with a summary of all the information you have supplied, with the exception of your email address. The members of staff at the Office who process your request will not see your email address.
