Registering a civil partnership entered into abroad in Luxembourg

If you have already registered a partnership abroad and wish to have it recognised in Luxembourg, you can apply to have it entered in the Luxembourg civil register.
You can apply to have your partnership registered in the civil register, maintained by the Prosecutor General's Office, if you wish to formalise your relationship in Luxembourg.
This is not a legal requirement, but registering with the civil register allows you to:
- treat your partnership entered into abroad in the same way as a Luxembourg partnership;
- enjoy the same benefits as partners who have entered into a partnership in Luxembourg (for example: tax benefits, social security benefits and employment law provisions).
Who is concerned
Prerequisites
You must have met the following conditions at the time of entering into your partnership:
- have the capacity to enter into a contract:
- have not been found legally incompetent;
- not be a non-emancipated minor or have protected adult status;
- not be bound by marriage or another partnership;
- not be relatives by blood or marriage, at the following levels:
- be legitimate or natural ascendants and descendants, and relatives in the same line;
- between siblings or relatives of the same degree;
- between uncle/aunt and nephew/niece;
- legally reside at the same address in Luxembourg.
How to proceed
Submitting the application
To have your partnership entered in the civil register, please submit your application, together with the supporting documents, to the Civil Register:
- by post; or
- in person, during opening hours.
Supporting documents
You must include specific documents with your application in order to:
- ensure the authenticity of the documents produced; and
- enable the Civil Register to check whether the conditions have been met.
These documents are:
- your partnership declaration registered abroad or a certificate of registration of the partnership declaration (the precise name of this document may vary from one country to another).
- if the document is issued by the authorities in another EU Member State, no apostille or legalised signature is needed. If the document is not in French, German or English, the following will be required:
- a multilingual form pursuant to the European Regulation (EU) 2016/1191; or
- a certified translation by a sworn translator;
- if it originates from a third country that is not an EU Member State, it must bear either an apostille from the competent court or the original of a legalisation of signature. If the documents is not drawn up in German, French or English, an official translation by a sworn translator must be attached; and
- if the document is issued by the authorities in another EU Member State, no apostille or legalised signature is needed. If the document is not in French, German or English, the following will be required:
- full, recent copies (dated within the last three months) of both your birth certificates issued by the communes in the places where you were born; and
- your certificates of residence issued by the relevant commune or a sworn statement certified by a civil registrar. This is to prove that you have a joint address to which the civil registry office can send your partnership certificate; and
- a copy of your valid passports or identity cards. If you are a national of a non-EU third country, you must provide a certified copy of your valid passport, which must include a residence permit valid for more than three months.
An apostille or legalisation of signature is issued by the competent authority of the country in which the document was drawn up.
A tourist visa (category C visa) in the passport is not valid for legal residence.
Review of the application
If all the required documents have been submitted and your partnership meets the criteria for recognition as a registered partnership under Luxembourg law, the Civil Registry Office will issue you with a certificate of partnership. The date on which the partnership was registered in the civil register is stated on this certificate.
By registering in this way, you are not entering into a new partnership in Luxembourg; you are simply transposing a partnership that was entered into abroad.
As long as a civil partnership is in force, whether registered abroad or in Luxembourg, you cannot register a new civil partnership in Luxembourg.
