Consulting the electoral rolls and filing appeals

The table below shows the provisions of electoral law pertaining to the procedure for finalising the electoral rolls and the procedure for appeals.

Finalisation of the electoral rolls and appeals (Art. 12-20)

55th day prior to the election date at 17.00:

  • provisional finalisation of the electoral rolls by the board of mayor and aldermen.

54th day before the election:

  • publication of a notice of deposit for public inspection of the provisional electoral rolls.

54th-47th day prior to the election date:

  • public inspection of the provisional electoral rolls;
  • lodging of complaints with the board of mayor and aldermen;
  • any citizen may produce documents, and receive a receipt, on behalf of people who are not included on the current rolls but have the right to be included.

No later than the 45th day before the election date: display of the list of complaints lodged (all citizens can inspect it and request a copy in writing).

No later than the 44th day before the election date:

  • the board of mayor and aldermen rules on all appeals at a public meeting;
  • if the board of mayor and aldermen decides to remove a voter from the electoral rolls, the voter is informed within 48 hours, by letter sent to the voter's address, including the reasons for the removal;
  • notice of the removal is sent by post with receipt requested. If the person in question has moved to another commune, a copy of the notice is sent to the mayor of that commune.

44th day prior to the election date:

  • the electoral rolls are definitively closed;
  • publication of a notice that the additional roll of newly registered voters has been filed.

44th-37th day prior to the election date:

  • the additional roll with the newly registered voters can be inspected by the public.

Within 8 days of the closing of the rolls, the communal administration sends the Minister of the Interior a copy of the final and additional rolls. If the deadline falls on a Saturday, it is extended to the following Monday.

44th-30th day before the election day: inspection of updated rolls by the public and possibility to request a copy of the rolls.

Appeal to the Administrative Court (Art. 21-30)

No later than the 37th day prior to the election date:
  • introduction of an appeal for review before the Administrative Court against any decision by which a person has been wrongly registered, omitted or struck off the electoral rolls;
  • the Administrative Court decides as a matter of urgency and in any case within 10 days of the submission of the application (accelerated procedure).
