Supplement for seniors

You are eligible for a financial supplement if your own personal financial resources are insufficient to pay for the services provided in:
- an approved residential care home for the elderly; or
- an approved sheltered accommodation.
This supplement covers:
- the cost of the accommodation;
- the maintenance and supply of flat linen (sheets, towels, gloves);
- the washing and marking of personal laundry (excluding dry cleaning);
- basic personal hygiene products (body, hair, face, hands, teeth, ears, nails);
- a television, a telephone and an internet connection with basic subscriptions.
Who is concerned
Any natural person who:
- lives in Luxembourg; and
- wants to receive a financial supplement to help pay for accommodation at an approved residential care home for the elderly or in an approved sheltered accommodation.
Applicants who are not nationals of Luxembourg, another EU Member State, or the Swiss Confederation, and who are not recognised as stateless persons or beneficiaries of international protection, must meet the following conditions:
- have lived in Luxembourg for at least 5 years over the course of the past 20 years; or
- have long-term resident status.
There are exceptions for some relatives of:
- EU, EEA or Swiss nationals; and
- beneficiaries of international protection.
Citizens of the EU, EEA or Switzerland (and their families) are not entitled to the supplement during the first 3 months of their stay, unless they are working.
Prerequisites
Conditions for receiving the supplement
To receive the supplement, you must:
- have been allocated a place in:
- an integrated centre for elderly people (centre intégré pour personnes âgées - CIPA); or
- a nursing home; or
- another type of medico-social establishment providing daytime and night-time care;
- lack sufficient income and/or savings to cover the cost of geriatric care;
- have the right of residence, be registered in the National Registry of Natural Persons (RNPP), and actually reside at the place where you have your usual place of residence.
You are not eligible for the supplement if you are already covered by another form of assistance granted under the law on free movement and immigration.
Time frame for new arrivals in Luxembourg
If you are an EU, EEA or Swiss national, you and your family will not be entitled to the supplement during your first 3 months in Luxembourg.
This does not apply if you are working.
How to proceed
Filing an application
You must apply by completing the 'Demande en obtention du complément' form (application for the supplement), which can be found below in the section 'Online services and forms'.
Page 1 of the form must be completed by an authorised representative of your accommodation provider.
The form must then be completed and signed by you.
If you require representation for the execution of legal acts, the application must be signed by:
- your legal representative; or
- the legal administrator, namely the guardian, trustee, official representative or person exercising judicial protection.
Calculation of the accommodation supplement
The monthly amount of the supplement is based on:
- the national average price of approved single rooms;
- the price of the room or accommodation that you are being offered (the price is divided by 2 in the case of a double room);
- a flat-rate mark-up to cover certain services and products;
- your personal resources and those of your spouse/partner, after deduction of a fixed monthly amount of EUR 629.23, based on an index of 968.04.
If the price of the housing rises above the national average or the applicable price, the organisation must:
- either maintain an accommodation price that is equal to or less than the national average; or
- allow you to move to a different approved room or facility.
Determining your personal resources
Your personal resources include all of your net monthly income and, where applicable, that of your spouse/partner. Personal resources include:
- salaries/wages;
- pensions;
- benefits;
- social inclusion income (REVIS) etc.
Some types of aid are not included in the calculation of your personal resources, namely:
- family benefits;
- birth and back-to-school allowances;
- state aid;
- emergency relief from voluntary organisations.
Determining your assets
Movable property
Your movable assets (savings, investments etc.) are included in your personal resources and must be used prior to any financial aid being received from the National Solidarity Fund (Fonds national de solidarité - FNS).
If the value of your assets exceeds EUR 24,201 (based on an index of 968.04), your application will be rejected.
This cap is doubled if the application covers both you and your spouse/partner.
Real estate
Any real estate that you own (in Luxembourg or abroad) is also taken into account. Its value is calculated as a life annuity according to official scales.
Inclusion of maintenance payments
To calculate the supplement, the FNS takes into account any maintenance payments to which you are entitled from:
- parents;
- adoptive parents;
- partners.
If you do not receive such payments, the FNS may ask you to assert your rights to them within 6 months.
The FNS may calculate the supplement as a lump sum to be paid to you, if you:
- do not claim such payments; or
- waive the right to such payments.
Situation of a couple where only one spouse/partner is being accommodated
If only one of you (you or your spouse/partner) is being accommodated in an establishment, the spouse/partner who continues to live at home will retain a minimum income:
- equal to the social minimum wage, if they have an income; or
- corresponding to the social inclusion income (REVIS), if they have no income.
In addition, housing expenses (rent or mortgage repayments) can be deducted up to a maximum of EUR 1,936.08 (based on an index of 968.04).
Repayment of the supplement
The FNS may:
- claim back the supplement paid if your financial situation improves;
- claim back the supplement paid to your beneficiary/legatee, subject to certain limits. No repayment can be requested from you if your gift was made more than 10 years prior to your application.
With regard to inheritance, the FNS cannot claim repayment of the supplement paid:
- on a minimum protected portion of the inheritance, which it cannot claim:
- EUR 287,962.85 (based on an index of 968.04), for spouse/partner or descendants;
- EUR 1,742.47 (based on an index of 968.04), for others;
- on the home in which the spouse/partner continues to live and its furnishings. On the other hand, the FNS may register a mortgage on this property to protect its rights.
Appeals
You may appeal against a decision handed down by the Chair of the Board of the FNS within 40 days of being notified of it.
Your appeal should be lodged directly with the Board of Directors of the FNS.
If you do not accept the decision handed down by the Board of Directors of the FNS, you may appeal within 40 days of being notified of it.
In that case, your appeal should be lodged directly with the Social Security Arbitration Tribunal (Conseil arbitral de la sécurité sociale - CASS).
