Summary:

From your MyGuichet.lu business eSpace, you can file certain procedures with the administrative courts, and receive messages from the courts.

The following can be filed through MyGuichet.lu:

  • applications for certification of a Lawyer's business eSpace;
  • applications for summary proceedings before the president of the Administrative Tribunal;
  • exhibits and other documents in connection with summary proceedings before the president of the Administrative Tribunal;
  • optionally, exhibits addressed to the administrative courts (exhibits must be filed with the clerk of the administrative courts in person, in accordance with Article 2 of the Law of 21 June 1999 (as amended) establishing rules of procedure before the administrative courts);
  • other documents addressed to the administrative courts.

After filing your documents electronically, you will receive certain documents issued by the administrative courts in your MyGuichet.lu business eSpace.

Who is concerned

Any lawyer who is registered on list 1, 2 or 4 of the Bar Association.

Prerequisites

Business eSpace

To be able to file a procedure with the administrative courts online, you must have a business eSpace.

How to create a business eSpace on MyGuichet.lu

There are 2 possible scenarios:

  1. You are a new user of MyGuichet.lu. You must:
    • first register on MyGuichet.lu; and
    • then create a business eSpace.
  2. You already have a private eSpace on MyGuichet.lu. You can directly create a business eSpace without having to register again.

Certification of a business eSpace

Your business eSpace must be certified by the relevant Bar Association.

You must apply for this certification online through your MyGuichet.lu business eSpace (under the procedure 'Barreau – Demande de certification de mon espace professionnel Avocat' (apply for certification of my Lawyer business eSpace)).

This procedure requires a LuxTrust product or an electronic identity card (eID).

How to proceed

Filing an application for a summary proceeding before the president of the Administrative Tribunal

This procedure is reserved for summary proceedings – Article 12(a) of the Law of 21 June 1999 (as amended) establishing rules of procedure before the administrative courts – in connection with administrative decisions issued by the government.

It is available to barristers only.

Applications for summary proceedings may be filed through your certified MyGuichet.lu business eSpace.

The application, along with a list of all exhibits, the documents themselves, and the contested administrative decision(s), must be attached at the end of the procedure.

The list of exhibits must mention all of the documents attached to the application. The listed exhibits and the documents themselves must be numbered sequentially in ascending order, and each one must have a title that clearly explains what it is (see Article 12(a) §2 of the Law of 21 June 1999, as amended).

This procedure requires a LuxTrust product or an electronic identity card (eID).

To ensure that the documents are filed successfully, each exhibit must be in PDF format and no more than 15 Mb in size.

If you are sending a large number of exhibits, you may send them as a zip archive.

Make sure to create one zip archive for each type of exhibit.

Document names may not contain the characters '\', '/', ':', '*', '?', '"','<', '>', and '|'

Filing exhibits or other documents

When necessary, you can file exhibits or other documents online through your certified MyGuichet.lu business eSpace.

The following types of exhibits can be filed:

  • documentary evidence;
  • confidential documents;
  • administrative files;
  • confidential administrative files;
  • tax files;
  • confidential tax files;
  • contested administrative decisions;
  • identity documents;
  • document lists.

Other types of documents can also be filed, including:

  • letters addressed to the president;
  • written arguments;
  • writs and court decisions;
  • appointment of a lawyer;
  • retainer agreements;
  • mandates issued by the government.

This procedure requires a LuxTrust product or an electronic identity card (eID).

Receipt of documents

After filing a procedure online, you will receive a number of documents in your MyGuichet.lu business eSpace, including:

  • a notice of registration;
  • a summons;
  • statements of case, exhibit lists, non-confidential supporting documents, and other documents, applications and so on filed by parties to the case;
  • notices of decisions handed down by magistrates;
  • copies of the decision.
