Applying for the review of a pension following an occupational accident or illness that occurred before 1 January 2011

When a person is incapacitated due to an accident at work / a commuting accident, or an occupational illness, they can request the revision of their occupational accident pension with the Accident Insurance Association (Association d'assurance accident - AAA), depending on the case and under certain conditions.
Who is concerned
Anyone who receives an accident pension as compensation for an occupational accident or illness that occurred before 1 January 2011.
Prerequisites
It is necessary that:
- the new permanent partial work incapacity (incapacité de travail partielle permanente - IPP) is no longer subject to change;
- the rate of deterioration is at least 10 % higher than that of the previous work incapacity.
Preliminary steps
The Social Security Medical Board sets the rate of permanent partial disability.
How to proceed
Revision of the pension annuity
In the event of further deterioration of the insured person's state of health by at least 10 %, the insured will be entitled to a new pension annuity.
The revision of the pension annuity can be applied for using the application form.
The form, duly completed and signed, must then be returned to the AAA.
The pension annuity is granted by the medical officer of the Social Security Medical Board after the consolidation of the injuries.
The new permanent partial disability rate takes effect the day following the filing of the application for review.
Increase in partial pension
The pension annuity of the insured person, who has an IPP of more than 50 % and one or more dependent children, is increased by 10 % for each dependent child. This increase is due:
- until the child reaches the age of majority; or
- until the child reaches the age of 27 provided he or she is enrolled in higher education; or
- without age limit for the child, if the child is disabled and unable to make a living.
If the insured person has at least 3 dependent children, the increase cannot exceed 25 % of the pension.
The income and supplements relating to children cannot exceed 100 % of the compensation used to calculate the pension.
If the insured receives multiple pensions, only the highest pension is increased.
Payment of the pension annuity
The definitive pension annuity is paid monthly, in advance.
The annuity is adjusted to the cost of living index value according to the terms applicable to civil servants' salaries and pensions.
The pension is not subject to social security contributions and tax.
When a pension takes effect after the first of the month, the monthly payment is paid proportionally beginning from the start date.
