Grievance or complaint to the National Council for the Judiciary

The law gives litigants the possibility of referring the following directly to the National Council for the Judiciary:
- complaints about the functioning of the justice system; or
- complaints in cases where they consider that the conduct of a member of the judiciary in the performance of their duties constitutes disciplinary misconduct.
Who is concerned
Anyone wishing to address a complaint to the National Council for the Judiciary concerning the functioning of the justice system or a disciplinary complaint against a member of the judiciary.

- Disciplinary complaint against a magistrate
You have noticed a dysfunction in the justice system during the course of a legal procedure.
Your complaint is not admissible if:
- it concerns the content of a court decision;
- it has a subject that you can address by exercising ordinary or extraordinary means of redress;
- it has already been processed and contains no new elements.
You are of the opinion that the conduct adopted by a magistrate during legal proceedings concerning you is contrary to ethical principles and could be the subject of disciplinary proceedings.
Your complaint is not admissible if:
- it is against a magistrate of the public prosecutor's office (a public prosecutor, for example) when the public prosecutor's office to which they belong is still in charge of the proceedings;
- it is directed against a judge who is still in charge of the proceedings;
- it has been submitted more than a year after an irrevocable decision that puts an end to the proceedings.

You can fill in the grievance/complaint form online (see 'Online services and forms'). You must then sign it electronically or by hand and send it to the National Council for the Judiciary:

- your identity, address and signature; and
- a summary of the alleged facts and grievances.

A complaint is not a supplementary means of redress. It does not allow you to challenge the court decisions themselves.
