Nationals of other States belonging to the European Economic Area (EEA) (Norway, Iceland and Liechtenstein) and Switzerland are treated as EU citizens.

Who is concerned

Provided they meet the conditions for admittance, the following may receive unemployment benefits.

  • unemployed persons receiving benefits  in another Member State of the EU, the EEA or Switzerland who move to Luxembourg;
  • conversely, unemployed persons initially receiving benefits from the ADEM who relocate to another Member State of the EU, the EEA or Switzerland.

Prerequisites

An unemployed worker who is a national of another Member State of the EU, the EEA or Switzerland who wishes to relocate to another EU country to seek employment may continue receiving their unemployment benefits, if they:

  • already receive unemployment benefits (and are thus registered as a jobseeker) in an EU Member State;
  • have been available to the employment department of that country for at least 4 weeks from the start of their unemployment.

Deadlines

Subject to meeting the conditions for admission, the unemployed person on benefits may continue to receive the monies received in their country of residence for a period of three months.

They must return to their country of origin before that period ends to continue receiving their benefits.

How to proceed

To continue receiving their unemployment benefits, the unemployed person who relocates to another EU Member State must:

  • prior to their departure, request a U2 form from the institution paying their unemployment benefits in their country of residence;
  • upon their arrival:
    • hand in this form to the employment department in their host country and register as a jobseeker within 7 days of the issuance of the U2 form;
    • remain available to the employment department (this period may be extended in certain circumstances).
