Requesting a reasonable accommodation

Reasonable accommodation consists in making the necessary and appropriate modifications and adjustments to a space open to the public to ensure accessibility for persons with particularly severe or specific disabilities.
Who is concerned
Anyone with a particularly severe or specific disability can apply for reasonable accommodation.
Prerequisites
The location that is the subject of the application does meet accessibility requirements, but these are not sufficient to allow the applicant to access it because of their particularly severe or specific disability.
How to proceed
Submitting the application
The person with a disability can apply for reasonable accommodation to the minister responsible for disability policy.
Applications must be submitted:
- either by post, using the specific form (see 'Online services and forms' below) which must be sent to:
Ministère de la Famille, des Solidarités, du Vivre ensemble et de l’Accueil

- or by email, using the specific form (see 'Online services and forms' below) which must be sent to: accessibilite@fm.etat.lu;
- or online via MyGuichet.lu or the MyGuichet.lu mobile application (see 'Online services and forms' below). This is a procedure with authentication that requires:
- a LuxTrust product; or
- an electronic identity card (eID).
Processing the application
On receipt of the application, the minister, considering the opinion of the Accessibility Advisory Council, will assess whether the reasonable accommodation represents a disproportionate burden or not.
Publicly accessible space
If the Minister decides that the requested accommodation does not create a disproportionate burden, he or she will notify the responsible parties of this decision and they will be obliged to carry out the requested accommodation within a reasonable time frame.
A copy of the Minister's decision is sent to the disabled person who made the request for reasonable accommodation.
If the minister decides that the requested development works represent a disproportionate burden, they will inform the disabled person who requested the works of this decision.
A copy of the Minister's refusal decision is sent to the parties who would have been responsible for the work for information purposes.
Publicly accessible space within a collective residential building
If the public space is located in a collective residential building, reasonable accommodation may be provided only with the agreement:
- of the owner of the building, if the building is owned by a single owner;
- of the commonholders or emphyteutic leaseholders association, if the building is a commonhold property;
- of the undivided co-owners, if the building is under undivided co-ownership between multiple co-owners.
Should they refuse, the reasonable accommodation is not made.
The decision of refusal is addressed to the disabled person who made the request for reasonable accommodation and a copy is addressed to the minister responsible for disability policy.
If necessary, the refusal is recorded in the minutes of the general meeting.
Sanctions
If the reasonable accommodation does not represent a disproportionate burden, then the refusal:
- may be considered as a case of discrimination on the grounds of disability;
- is punishable by:
- imprisonment of between 8 days and 2 years; and/or
- a fine of between EUR 251 and EUR 25,000.
Good to know
Financial aid for reasonable accommodation, in the form of a cash subsidy, may be made available by the Minister responsible for disability policy.
