Application for accreditation to issue energy performance certificates for buildings

Energy performance assessments and energy performance certificates (Certificat de performance énergétique - CPE) for residential and non-residential buildings can be issued by:

  • architects and consulting engineers, provided they are members of the Order of Architects and Consulting Engineers (Ordre des architectes et des ingénieurs-conseils - OAI); or
  • natural or legal persons who have been accredited by the Minister responsible for energy matters.

CPEs for new, non-residential buildings equipped with an active cooling system can only be issued by consulting engineers that are members of the OAI. The above-mentioned documents are issued in accordance with the provisions of the amended Grand Ducal regulation of 9 June 2021 on the energy performance of buildings (Règlement grand-ducal modifié du 9 juin 2021 concernant la performance énergétique des bâtiments).

These OAI members may issue the documents mentioned above without seeking prior approval from the Minister responsible for energy matters.

Any other persons or groups of persons who wish to be accredited to issue CPEs for residential and non-residential buildings, with the exception of new, non-residential buildings equipped with an active cooling system, must:

  • satisfy the required conditions (see 'Prerequisites');
  • file an application with the Minister responsible for energy matters ('Minister').

Who is concerned

OAI members apart, all:

  • natural persons: private individuals and sole proprietors acting in their own name; and
  • legal persons: groups having a legal personality, such as civil or commercial companies.

Applications for legal persons:

  • must be completed and signed by one of the organisation's managers, who must satisfy the prerequisites;
  • may include employees working for the legal person:
    • who must satisfy the prerequisites;
    • so that they can issue energy performance assessments and energy performance certificates on behalf of the legal person.

Prerequisites

The applicant must:

  • be morally, technically and financially independent with regard to the assignments that will be entrusted to them;
  • prove that they have:
    • undergone suitable technical or professional training; or
    • at least 5 years' work experience in the field concerned;
    • satisfactory knowledge of the regulations applicable to the technical tasks that they will be entrusted with; and
    • sufficient practical experience in performing those tasks;
  • have:
    • appropriate technical resources; and
    • where applicable, the staff required to perform the tasks in connection with their assignments in an appropriate manner;
  • have access to the equipment and information required for them to undertake their assignments in an appropriate manner;
  • have the skills required to draw up the certificates, statements and reports that formalise the assessments and inspections that they have carried out;
  • take out contractual and extra-contractual professional civil liability insurance:
    • covering all types of damages;
    • with a minimal amount of EUR 1,240,000;
    • with a minimal amount of EUR 500,000 for immaterial damages, where applicable;
    • to be renewed every year for however long the accreditation is granted for.

Designers, suppliers, and project leads and contractors, as well as the representatives of these persons, cannot be accredited.

How to proceed

Filing an application

Two types of forms can be used to file an application for accreditation:

  • one is reserved for natural persons;
  • and the other for legal persons.

In both forms, the applicant must tick a box to indicate whether the application is being filed:

  • as a new application; or
  • to update to an existing accreditation; or
  • to renew an existing accreditation.

New application for accreditation

New applications for accreditation must be filed using a special form (see 'Online services and forms' below).

Natural persons may apply for accreditation in their own name and on their own behalf using the form intended for natural persons. Energy performance certificates and assessments will be issued in their name.

For legal persons, the application must be filed by the legal representative of the group, in their own name but on behalf of the group, using the form intended for legal persons. Energy performance certificates and assessments will be issued in the group's name.

The duly completed application form must be accompanied by the following documents:

  • where applicable, a copy of a document attesting to the publication of the legal person's articles of association;
  • a copy of a professional civil liability insurance policy.

The following documents must be submitted for every natural person included in the application:

  • proof that they are familiar with the regulations applicable to the technical tasks mentioned in the application (e.g. LuxEeB courses);
  • proof of approved diplomas or diplomas listed in the register of certificates (registre des titres de formation); and
  • where applicable, a list of the courses attended, attesting to the completion of an appropriate number of courses on the energy performance of buildings; or
  • in the absence of proof of a diploma, proof of work experience, such as a list of recently undertaken works/assignments in connection with the area(s) of expertise being applied for.

Updating the accreditation

An application to update the accreditation can be filed at any time using the relevant form (see 'Online services and forms' below). Updating is understood to mean:

  • a change in the legal person's articles of association;
  • the cessation of business by the legal person;
  • the addition of an employee to the legal person's accreditation;
  • the addition of a natural person;
  • the removal of an employee from the legal person's accreditation.

The Minister must be informed immediately of any change in connection with the accreditation using the application form, which must be:

  • duly completed;
  • accompanied by any documents in support of the change to the accreditation.

Renewal of the accreditation

The accreditation:

  • is valid for 5 years from the date appearing in the ministerial decree confirming the accreditation;
  • is not automatically renewed.

Accreditation renewal applications must be filed:

  • at least 3 months before the accreditation expires;
  • using the relevant form (see 'Online services and forms' below);
  • accompanied by a copy of a professional civil liability insurance policy.
