An accident on the way to work: what to do?

Inform your employer
If you have an accident on the way from your home to your place of work, you must, in principle, notify your employer immediately so that they can report the accident to the Accident Insurance Association (Association d’assurance accident - AAA).
For the accident to be covered by the AAA, it must:
- have occurred in the context of your professional activity (for example, on your way to work); and
- cause a bodily injury and/or damage to a vehicle.
The insured person is entitled to the following benefits:
- compensation (property damage and physical injury);
- benefits in kind;
- cash benefits;
- annuities and allowances.
Booking an appointment with the AAA
Depending on the circumstances of the accident, you may need to book an appointment with the AAA to receive personalised information.
Appointments are free of charge and can be made:
- either online using MyGuichet.lu;
- by phone at (+352) 26 19 15-1 (available from Monday to Friday from 08.00 to 16.00); or
- by email to the following address: prestations.aaa@secu.lu.

Declaring an incapacity for work
The consequences of your accident may require you to be absent from work for a more or less lengthy period.
If you are employed in the private sector:
- you must notify your employer from the 1st day of your absence;
- you must, no later than the 3rd day of your incapacity for work, send section 1 of your medical certificate to the National Health Fund (Caisse nationale de santé - CNS) and section 2 to your employer.
If you are self-employed:
- you must, no later than the 3rd day of your incapacity for work, send section 1 of your medical certificate to the National Health Fund (Caisse nationale de santé - CNS).
If you are a civil servant:
- you must inform your line manager of your absence as soon as possible;
- if you are absent for more than 3 days, you must provide a medical certificate. The medical certificate must reach the head of administration or their delegate no later than 2 days after it is issued.
What benefits are you entitled to?
If your accident has been covered by the AAA, you may be entitled to several different types of benefits. These can be:
- a compensation, whether for damage to property or bodily injury;
- benefits in kind consisting in the coverage of health care expenses related to an accident at work or a commuting accident;
- benefits in cash in the event of total incapacity for work, for the first 78 weeks, corresponding to the payment of the insured party's salary and other benefits during the period of incapacity for work;
- allocation of an annuity (full annuity, a tideover allowance or a professional tideover allowance) or compensation for non-patrimonial damages.
Good to know
Material damage caused by a vehicle to property must be declared to the Police.
The declaration can be made online via MyGuichet.lu.
The Police no longer issues certificates for accidents involving game because insurance companies and the Automobile Club of Luxembourg (ACL) no longer require this certificate.
