You can request a restriction on access to the Register of Trusts and Fiduciary Contracts (RFT) in exceptional circumstances.

The beneficial owners of a fiduciary contract or trust registered in the Register of Trusts and Fiduciary Contracts (RFT), or their representative, may request the Registration Duties, Estates and VAT Authority (AED), on a case-by-case basis and in exceptional circumstances, that access to certain information contained in the register be restricted to:

  • national authorities;
  • self-regulatory bodies;
  • credit institutions;
  • financial institutions; and
  • bailiffs and notaries acting as public officials.

Requests to restrict access to certain information in the RFT can be made online via MyGuichet.lu.

Who is concerned

Beneficial owners of a fiduciary contract or a trust registered with the RFT or their representative.

Prerequisites

You must demonstrate that access to the information concerning you exposes you to a disproportionate risk or a risk of:

  • fraud;
  • kidnapping;
  • blackmail;
  • extortion;
  • harassment;
  • violence; or
  • intimidation.

Access restrictions are also possible when the beneficial owner is:

  • a minor; or
  • incompetent.

Costs

The request to restrict access is free of charge.

How to proceed

Filing an application

You must submit your request to restrict access to the AED online via MyGuichet.lu.

This procedure requires a LuxTrust product or an electronic identity card (eID). The procedure is also available in the mobile app.

You must complete the information requested by the MyGuichet.lu assistant and, in particular, specify the information for which access must be restricted.

You must submit a separate application for each fiduciary contract or trust concerned.

The AED reserves the right to reject any application that is incomplete or does not comply with legal and regulatory provisions.

Supporting documents

You must enclose the documents specified by the MyGuichet.lu assistant with your application. These documents include any document that establishes the exceptional circumstances justifying your request.

Duration of the access restriction

Upon receipt of your request, the AED will temporarily restrict access to your information to authorised persons.

When access restriction is granted, its duration will be equal to the duration of the circumstances justifying it, without exceeding three years.

You can request a renewal of the restriction from the AED no later than one month before its expiry date.

Refusal

If your request is refused by the AED, access to your information will be restricted for a period of one month.

You can appeal against a refusal before the administrative court within one month of notification of the decision. In that case, the restriction will be maintained until all legal remedies have been exhausted.

Publication of access restrictions

A notice regarding the restriction of access to information is published on the AED website for a period of one month.
