Resolving a dispute between a tenant and landlord on the setting of rent and/or additional rental expenses

Summary:

When there is a disagreement between the landlord and the tenant regarding the amount of rent and/or rental charges, the matter must be referred to the competent rent commission to settle the dispute.

Sometimes there can be a disagreement between the landlord and the tenant concerning the amount of rent and/or rental charges.

If the landlord and tenant cannot reach an amicable agreement, it is possible to bring the matter to the Rent Committee of their commune in order to submit a request for:

  • an increase in rent for the owner; 
  • a reduction in rent for the tenant.

Rent Committees set up by communal administrations are conciliation bodies that can often reach agreements thereby avoiding legal proceedings.

Communes with:

  • more than 6,000 inhabitants have their own Rent Committee;
  • fewer than 6,000 inhabitants are attached to the Rent Committee in charge of the canton.

Who is concerned

Parties involved

Any owner or tenant (natural persons) of a residential property, including in the case of joint tenancy.

Dwellings excluded

The following cases do not fall under the above-mentioned rental agreements:

  • premises:
    • for commercial use;
    • for administrative use;
    • for industrial use;
    • for craft use; or
    • used for liberal profession purposes;
  • secondary residences;
  • premises that are separate from a main dwelling (such as a garage not attached to a house);
  • hotel rooms;
  • shelters for temporary accommodation of applicants for international protection, refugees, etc.;
  • furnished or unfurnished dwellings in special accommodation facilities (retirement homes, integrated centres for the elderly, etc.);
  • furnished or unfurnished dwellings made available to natural persons as part of a social assistance programme implemented by a commune, an association of communes, etc.

Prerequisites

Before submitting a request to the Rent Committee, you (owner or tenant) must inform the other party of your intention in writing. This information should preferably be sent by registered letter with acknowledgement of receipt. Failing this, the request submitted to the Rent Committee will not be admissible.

This letter is considered to be an attempt to reach an agreement prior to taking the case to the Rent Committee.

Deadlines

You must wait:

  • one month after sending the letter to the other party, before you can refer the matter to the Rent Committee;
  • 6 months after the start of the lease: in order to calculate this period, it is not the date of signature of the lease agreement that is taken into account, but the date on which the tenant takes possession of the keys for the rented premises.

A tenant who agrees to a certain amount of rent when signing a lease cannot apply to the Rent Committee for a reduction in rent immediately after signing the lease.

How to proceed

Filing the application

You submit a request to the college of mayor and aldermen of the commune where the rented property is located. Your request must specify the reason for the application (increase/reduction in rent and/or charges).

The college will then forward your request to the competent Rent Committee.

The Rent Committee only settles disputes relating to the setting of rent and rental charges.

Supporting documents

You must also enclose the following documents with your request:

  • a copy of the lease;
  • where applicable, a copy of any amendments to the lease agreement;
  • a copy of the letter sent to the other party;
  • where applicable, a copy of the response to the letter;
  • where applicable, photographs of the accommodation;
  • all other documents deemed useful.

Summons

You will be summoned by registered letter with acknowledgement of receipt no earlier than 8 days after receipt of the request.

The summons contains:

  • the date, time and place to appear before the Rent Committee;
  • a copy of the request.

If you have not received a summons, the Rent Committee will summon you again within 15 days. The second summons is validly served at the address where you are registered.

Appearing before the Committee

Before the Rent Committee, you can:

  • appear in person; or
  • be assisted or represented by an authorised representative, i.e. someone who has the power to act on your behalf, such as a solicitor;
  • present your observations;

The Rent Committee can:

  • visit the rented accommodation;
  • appoint an expert/consultant to clarify certain issues that have been raised.

The appraisal fees are:

  • paid in advance by the person who submitted the request;
  • ultimately payable by the party designated by the Rent Committee at the end of the case.

Decision

The Rent Committee draws up a statement that:

  • in the event of a successful mediation:
    • contains the terms and conditions of the arrangement;
    • is signed by:
      • the parties (or their authorised representative);
      • the president of the Committee;
  • in the event of failure to reach an agreement or failure to appear by one of the parties:
    • determines the rent due and/or advance payments for charges;
    • is signed by the members of the Committee;
    • contains the property valuation and the amount of rent;
    • will be sent to the parties by registered letter as soon as possible.

When the parties have tasked the Rent Committee with arbitration, the decision will be binding on the parties and may come into effect immediately.

Deadline for a response from the Rental Committee

The Committee is required to hand down its decision within 3 months of the date of submission of the request. If no decision is made within this time frame, you can directly file a claim with the justice of the peace.

Date of effect of the Rent Committee's decision

The decision to set the rent can only take effect from the first rent payment following the date on which the College of Mayor and Aldermen received the request.

The tenant may terminate the lease after a notice period of 3 months, unless otherwise agreed.

Appeal against the Rent Committee's decision

The decision rendered by the Rent Committee:

  • is not a judicial decision;
  • is only applicable if the parties expressly or implicitly accept it.

Each party may lodge an appeal against the decision of the Rent Committee within one month before the competent magistrate's court. Which magistrate's court is competent depends on the locality of the rented accommodation. The time limit is set to commence upon notification of the Committee's decision to the parties by registered letter.

The absence of an appeal means that the parties accept the decision.

Therefore, if one of the parties (for example, the landlord) has not brought an action against this decision within the time limit, they:

  • are deemed to have accepted it, including any costs incurred by them;
  • cannot request an increase or modification of the rent in the context of an appeal before the justice of the peace.
