All deeds of property documenting divisions, sharing, plots or any other forms of division of land (leasing, sales, inheritance, etc.) must be accompanied by a measured plan signed by an official surveyor, dated at most one year earlier.
If there is an existing plan but it has expired (i.e. its end date of validity has passed), it must be updated in line with the land registry documents held by the Land Registry and Topography Administration (Administration du cadrastre et de topographie – ACT).
The relevant application form—and, where applicable, its annexes—may be filled in, signed and sent electronically to the competent body (refer to the instructions on the cover page of the form). Who is concerned
Anyone owning land—whether or not it is built upon—in the Grand Duchy of Luxembourg, who wants to sell, rent out or bequeath that property, either in part or in its entirety, and who needs an official measurement of the property for that purpose.
How to proceed
The request for measurement is lodged using the relevant application form, which is to be filled in by the applicant and sent to the ACT.
For the plot of land in question, the applicant is asked to provide the following information:
- the commune;
- the section of the commune;
- the land registry number.
That information can be obtained from the ACT or, possibly, from the communal administration in question. The competent regional bureau of the ACT will then notify the applicant, by post, of the surveyor who will carry out the measurements. Once they have received that letter, the applicant can arrange an appointment for the measurements to actually be carried out.
