Le Pacs est un partenariat sans être marié.
On dit aussi : se pacser, enregistrer un partenariat de vie.
2 personnes ont une relation.
Il peut s’agir de :
- 1 homme et 1 femme
- 2 hommes
- ou de 2 femmes.
Ces 2 personnes sont partenaires de vie.
Elles vivent ensemble dans un même foyer
et ne sont pas mariées.
Elles peuvent enregistrer leur partenariat à la commune.
Le partenariat est alors officiellement reconnu par la loi.
Les partenaires de vie ont des droits et des devoirs.
Qui peut faire enregistrer un partenariat ?
Toute personne qui habite au Luxembourg
et qui a son adresse au Luxembourg.
La nationalité des partenaires n’est pas importante.
Ce n’est pas important s’ils sont homme ou femme.
Les partenaires doivent être majeurs.
Majeur veut dire :
- Ils doivent avoir au moins 18 ans.
- Ils doivent avoir tous les droits.
- Ils doivent avoir la capacité légale.
Capacité légale veut dire :
ils sont autorisés à signer des documents officiels.
Les partenaires doivent suivre des règles :
- Ils ne sont pas mariés.
- Ils ne sont pas dans un autre partenariat.
- Ils habitent ensemble à la même adresse.
- Ils ne sont pas de la même famille proche :
- Ils ne sont pas parent et enfant.
- Ils ne sont pas frère et sœur.
- Ils ne sont pas oncle et tante.
- Ils ne sont pas neveu et nièce.
La commune contrôle si les 2 partenaires vivent à la même adresse
dans le registre national des personnes physiques.
Dans le registre national des personnes physiques
sont écrites les informations suivantes :
- les noms et prénoms d'une personne
- le matricule : c’est le numéro d’identification national
- l’adresse
- la date de naissance et le lieu de naissance.
Quels documents sont demandés ?
Les partenaires de vie peuvent se renseigner à la commune.
La commune dit quels papiers sont nécessaires pour enregistrer le partenariat.
Les 2 partenaires de vie doivent donner
les documents suivants à la commune :
- Copies des 2 cartes d’identités s’ils sont Luxembourgeois
ou citoyens de l’Union Européenne.
Ou une copie de leurs passeports s’ils viennent d’un pays
en dehors de l’Union Européenne.
- Copies des 2 actes de naissance.
Les copies doivent avoir moins de 3 mois
si elles sont faites au Luxembourg.
Les copies doivent avoir moins de 6 mois
si elles sont faites à l’étranger.
Au Luxembourg, vous pouvez avoir votre acte de naissance
à la commune où vous êtes né.
- les partenaires de vie signent un papier
qu’ils ne sont pas de la même famille proche.
Les Luxembourgeois qui sont nés à l’étranger :
ils ont toujours besoin du papier qui prouve
qu’ils ne sont pas déjà pacsés ou mariés.

Elles ont besoin d’une preuve du divorce.
C’est le plus souvent le certificat de mariage.
Ou elles ont besoin d’autre preuve que le mariage n’existe plus.
Les personnes qui sont veuves :
Être veuf ou veuve veut dire :
être marié, mais le partenaire est décédé.
Ces personnes ont besoin d’une preuve
que leur partenaire est décédé.
Les personnes qui étaient dans un partenariat
avant le 1er novembre 2010 :
Ces personnes ont besoin d’une preuve qu’elles ne sont plus
dans un partenariat avec leur ancien partenaire.
Dans quelle langue doivent être les papiers ?
Les papiers doivent être écrits en allemand
ou en français ou en anglais.
Si les documents sont écrits dans une autre langue,
alors un traducteur doit traduire les documents.
La liste des traducteurs se trouve sur la page du
Ministère de la Justice.
Un traducteur qui n’est pas sur la liste
ne peut pas faire cette traduction.
Quand la commune a reçu tous les papiers,
la commune donne un rendez-vous.
Les partenaires de vie ne peuvent pas aller signer
sans rendez-vous.
Que fait la commune avec la demande de partenariat ?
La commune :
- Vérifie tous les papiers remis par les partenaires.
- Vérifie les informations des partenaires.
- Écrit le papier qui sert de preuve que le Pacs existe.
- Envoie le papier qui sert de preuve au registre de l’état civil.
- Envoie le papier qui sert de preuve aux partenaires
par courrier postal.
Le Pacs est seulement officiel quand il est inscrit
dans le registre de l’état civil.
Les partenaires de vie doivent garder le papier qui sert de preuve.
La commune envoie quelques copies aux partenaires.
