In order to guarantee the compliance of foodstuffs, as well as materials and articles intended to come into contact with food, with the national and European legislation and to allow the efficient organisation of official controls of food establishments, all operators in the food sector must be known by the competent authorities.
For this to happen, all operators must notify the activities of establishments under their responsibility to the Commissariat for Food Safety (Commissariat alimentaire).
They must notify the name of the establishment (e.g. name of the restaurant, name of the day care centre - "maison relais", name of the point of sale, etc.) and the address where the activities take place.
The indication of the address of a fiduciary which is hosting the registered office is not permitted.
In addition, the contact details and address of the food operator must be notified in order to designate a person responsible for the maintenance of regulatory food safety requirements, a recipient of official control reports and contact points for rapid alerts or food-related incidents, and materials and articles intended to come into contact with food.
Each business or establishment (public or private, for profit or non-profit) active in the production, transformation or distribution of foodstuffs or materials and articles intended to come into contact with food must be registered with the Commissariat for Food Safety.
As a general rule, the activities listed concern all the businesses who are active in any of the steps related to the production, transformation and distribution of foodstuffs and materials and articles intended to come into contact with food (except for slaughterhouses or businesses active in the feed sector who are subject to other types of registration).
Applicants are required to submit an online application for registration using MyGuichet.lu:
Within 15 working days, the operator will receive:
The operator may commence operation as soon as the application has been mailed; it is not necessary to wait for the acknowledgement of receipt or the letter requesting a modification.
Any modification or cessation of activity must be notified by the business operator to the Commissariat for Food Safety via the online registration procedure on MyGuichet.lu:
Upon request made to firstname.lastname@example.org, an access code will be sent to the operator by post which will allow them to consult their registration data online, modify it and send it to the Commissariat for Food Safety.
To do this, the email must show the national registration number (example LU-XXXXX-Et or LU-XXXXX-En) which is indicated on the acknowledgement of receipt sent by the Commissariat for Food Safety or the name and address of the food establishment.
This functionality is explained in a tutorial.
