Certain relatives of an insured person who died before the age of 65 as a result of an occupational disease, an accident at work or a commuting accident can benefit from a survivor's pension to compensate for the loss of financial support caused by the person's death.Depending on the case, this can be an orphan's pension or a pension of the surviving spouse or partner.
Who is concerned
Persons related to the insured person who can claim a survivor's pension are:
- the surviving spouse or partner;
- legitimate, natural or adoptive children;
Children applying for a survivor's pension must be under the age of 18.
However, young adults who are studying to prepare for their future profession can apply for a survivor's pension until they are 27 years old.
Only spouses or partners who remain single may receive a survivor's pension.In case of remarriage or a new partnership, the former spouse/partner will no longer benefit from the survivor's pension in the month following the new marriage/partnership.
Interested parties must send their pension application to the Accident Insurance Association (Association d'assurance accident - AAA) within a period of 3 years from the death of the insured person.
How to proceed
Applying for the pension
Orphans over the age of 18 must attach a certificate of education from an official body to the form.
The AAA verifies if the person fulfills the admission requirements, then calculates the personal income of the person concerned. It then transmits the information to the National Pension Insurance Fund (Caisse nationale d'assurance pension - CNAP) who will calculate and pay the amount of the survivor's pension.
The AAA will transmit the information of the amount to the interested party in the form of a decision of their president.
It should be noted that survivors who benefit from a transitional special pension scheme are entitled to a survivor's pension from the National Pension Insurance Fund instead of a survivor's pension from the AAA. Interested persons should contact the State Centre for Human Resources and Organisation Management.
Interested parties have several means of appeal at their disposal to assert their rights.
