Who is concernedAnyone who receives an accident pension as compensation for an accident or occupational disease that occurred before 1 January 2011.
It is necessary that:
- the new permanent partial work incapacity (incapacité de travail partielle permanente - IPP) is no longer subject to change;
- the rate of deterioration is at least 10 % higher than that of the previous work incapacity.
The Social Security Medical Board defines the rate of permanent partial disability.
How to proceed
Revision of the pension
In the event of further deterioration of the insured person's state of health by at least 10 %, the insured will be entitled to a new pension.
The pension should be requested using a specific form.
The form, duly completed and signed, must then be returned to the AAA. The pension is granted by the medical officer of the Social Security Medical Board after the consolidation of the injuries.
The new permanent partial disability rate takes effect the day following the filing of the application for review.
Increase in partial pension
The pension of the insured person, who has an IPP of more than 50 % and one or more dependent children, is increased by 10 % for each dependent child. This supplement continues until the child is of age or until it reaches the age of 27 if the child is a student, and has no age limit if the child is disabled and unable to work.
If the insured person has at least 3 dependent children, the increase cannot exceed 25 % of the pension.
The income and supplements relating to children cannot exceed 100 % of the compensation used to calculate the pension. If the insured receives multiple pensions, only the highest pension is increased.
Payment of the pension
The pension is paid monthly, in advance.
The pension is adjusted to the cost of living index value according to the terms applicable to civil servants' salaries and pensions.
The pension is not subject to social security contributions and tax.
When a pension takes effect after the first of the month, the monthly payment is paid proportionally beginning from the start date.
