Declaring one's move to a new commune of residence
Any person, regardless of nationality, who establishes residence in a commune of Luxembourg must, upon their arrival, declare their presence to the census office (Bureau de la population) of the communal administration of their new place of residence.
Moreover, foreign nationals are subject to the formalities governing the entry and stay of foreigners.
Any person who leaves the Grand-Duchy of Luxembourg to reside abroad must declare their departure from Luxembourg to the communal administration of their (former) place of residence.
By virtue of the principle of communal autonomy, the
declaration procedures
may vary from one commune to another.
Who is concerned
Any person who wishes to take up residence in a Luxembourg commune, or move to another commune in Luxembourg, whether they are a European Union national, a national of a country treated as such, or a third-country national.
All declarations must be made by the person concerned, or by their representative, who will be required to produce a currently valid ID document and the document on the basis of which they are acting, and who may be the declarant's:
- registered spouse or partner with whom they usually reside;
- guardian or trustee;
- legal administrator or ad hoc administrator;
- special representative.
Non-emancipated minors are represented by
their parents' representative who has parental authority, or by their guardian.
Any person who wishes to leave Luxembourg to reside in another country must declare their departure to their current commune of residence before their departure.
Prerequisites
Citizens of a Member State of the European Union (EU) (or of a country treated as a Member State) and the members of their family must be in possession of a national identity card or a currently valid passport (with the required visa, where applicable).
The following countries are treated as European Union Member States:
- Iceland, Liechtenstein and Norway as signatories of the European Economic Area Agreement (EEA);
- the Swiss Confederation.
Third-party nationals must be in possession of:
- a currently valid passport and, where applicable, the required visa;
- in the case of a stay longer than 90 days: an authorisation to stay issued prior to their arrival in Luxembourg (except for family members of an EU citizen).
How to proceed
Moving within the same commune or to another commune in Luxembourg
All persons who move to another commune in Luxembourg must file a declaration with their new commune of residence. The declaration of arrival must be filed within 8 days of occupying the new residence.
The
communal administration of the new place of residence
will see to it that the person is removed from the communal register
of their former commune of residence.
Declaration in person of the change of residence
The declarant must go in in person and present their valid identity card or passport. In the case of a change in family situation, they may be required to provide additional supporting documents.
Online declaration of the change of residence
Persons already having their usual place of residence in Luxembourg can submit their declaration of arrival online via MyGuichet.lu for certain communes.
The declaration of the change of residence may apply to a single person but also to their spouse or registered partner, respectively their minor children, provided they live at the same address.
It is recommended to attach to the declaration of arrival a supporting document attesting the usual place of residence such as the agreement of the owner or occupant of the accommodation, an extract from the lease contract, an extract from the notarial deed of sale, etc.
The application for rectification of data in the RNPP
is not to be used in this case. Only the declaration of change of usual place of residence is to be carried out using MyGuichet.lu.
Documents to be provided by nationals of the European Union and countries treated as such, and by third-country nationals
European Union (EU) nationals, or nationals of a country treated as such, who previously lived in another Luxembourg commune, must also provide a certificate of registration.
Third-country nationals must provide, along with their declaration, where applicable:
- their authorisation to stay;
- their residence permit;
- their visa.
Following the filing of their declaration of arrival with the commune, the declarant can apply for a residence certificate for themselves and the members of their family. Such a certificate may serve as justification for the granting of extraordinary leave for employee relocation.
Moving to Luxembourg from abroad
The formalities to be accomplished when moving to Luxembourg differ depending on whether the person who wishes to move to Luxembourg is a national of a Member State of the European Union (EU) or of a country that is treated as such, or a third-country national.
EU nationals or nationals of a country treated as such and the members of their family
EU nationals or nationals of a country treated as such, as well as the members of their family (regardless of their nationality), must declare their arrival with the commune of residence if they plan to stay longer than 3 months in Luxembourg.
The declarant must go in to the offices of the commune of arrival in person with the following items:
- a currently valid ID card or passport accompanied, where applicable, by the required visa, or a residence permit issued by another member state of the EU;
- their family record book or, if none:
- their certificate of marriage or registered partnership;
- the children's birth certificates.
Additional documents may be required by the commune.
It is therefore advisable to get in touch with the competent communal administration office in advance.
If the documents are not drawn up in German, French or English, an official translation by a 'sworn translator' must be attached.
Following their declaration of arrival to the communal authorities, the declarant can apply for a residence certificate for themselves and the members of their family. Such a certificate may serve as justification for the granting of extraordinary leave for employee relocation.
Within 90 days of their arrival in Luxembourg, the declarant must also complete the following, with the same communal administration:
- a declaration of registration;
- an application for a residence permit for family members of a citizen of the EU, if they are a member of the family of the EU national but themselves a third-country national.
Third-country nationals
Third-country nationals who are not family members of an EU national (or a national of a country treated as such) must declare their arrival with the commune of their stay within 3 days of their arrival in Luxembourg, regardless of how long they plan to stay in the country.
Third-country nationals who intend to stay less than 3 months in Luxembourg must declare their arrival with the commune, and produce the following:
- a valid travel document, and where applicable, a visa;
- their family record book or, if none:
- their certificate of marriage or registered partnership;
- the children's birth certificates.
Third-country nationals who intend to stay longer than 3 months in Luxembourg must go in to the offices of the commune of arrival in person with the following items:
- the original authorisation to stay obtained before arriving in Luxembourg;
- their currently valid passport accompanied, where applicable, by the required visa or a valid residence permit issued by another Member State of the Schengen Area;
- their family record book or, if none:
- their certificate of marriage or registered partnership;
- the children's birth certificates.
Additional documents may be required by the commune. It is therefore advisable to get in touch with the competent communal administration office in advance.
If the documents are not drawn up in German, French or English, an official translation by a 'sworn translator' must be attached.
Within 90 days of their arrival, third-country nationals who have obtained a temporary authorisation to stay and who wish to stay longer than 90 days in Luxembourg, must file an application for a residence permit corresponding to the category of their authorisation to stay (employee, self-employed, trainee, etc.) with the Immigration Directorate of the Ministry of Foreign and European Affairs.
Following the filing of their declaration of arrival with the commune, the declarant can apply for a residence certificate for themselves and the members of their family. Such a certificate may serve as justification for the granting of extraordinary leave for employee relocation.
Moving abroad
In the case of the departure from Luxembourg in order to settle down in another country, a declaration of departure must be filed with the current commune of residence before the departure.
The declaration of departure must be filed no later than on the day before the departure, and must be signed by the person who made the declaration.
Some communes allow the online declaration of departure using MyGuichet.lu.
The online declaration of change of residence may apply to a single person but also to their spouse or registered partner, respectively their minor children, provided they live at the same address.
In the case of a move abroad, the Ministry of Foreign and European Affairs advises Luxembourg citizens to register with a diplomatic or consular mission abroad.
In the case of a departure for longer than 6 months, third-country nationals holding a residence permit must return the latter to the Directorate of Immigration of the Ministry of Foreign and European Affairs.
Agencies to contact following a change of address
In theory, state ministries and administrations are automatically informed of changes of address through the National Register of Natural Persons (Registre national des personnes physiques).
As such, citizens will no longer need to provide Luxembourg public agencies with proof of their change of residence.
The Luxembourg Inland Revenue (Administration des contributions directes - ACD) will send a new tax card to residents who have moved to another address. The new tax card should be given to the employer.
Each citizen owning a vehicle registered in the Grand-Duchy of Luxembourg must contact the National Society of Automotive Traffic (Société nationale de circulation automobile - SNCA) within 1 month in order to update the address indicated on the certificate of registration of their vehicle, i.e., the grey card (carte grise).
In addition, when moving to Luxembourg from abroad, holders of a driver's license issued in a foreign country may be required to register or to transcribe their driver's license.
