Preservation & Termination of a business
Given the evolution of the pandemic, reinforced health measures have been put in place. In this context, the deadline for submitting applications for short-time work for the month of November 2020 has been adapted as an exceptional measure.
While these applications must normally be submitted no later than the 12th of the month preceding the month concerned by the application, the applications for the month of November may exceptionally be submitted up to and including 5 November 2020.
An exceptional procedure has been put in place for companies that:
The companies concerned can, between now and 5 November, download the specific form, complete it, sign it and return it, as soon as possible, by email to the following address: firstname.lastname@example.org.
The following must be attached to this form:
Please note that companies which had already submitted an application for short-time work for the month of November may, exceptionally, correct the number of employees concerned when the final account is submitted to ADEM, while taking care to comply with the rules in force concerning the maximum percentage of the workforce that may be targeted.
This exceptional procedure is only valid for the month of November. This means in practice that exceptional applications for the month of November may be submitted in parallel with the applications for the month of December (until 5 November), according to the usual procedure.
For applications concerning the month of December, the usual procedure applies. Please note that the usual procedure provides that applications must be made in advance, each month, between the 1st and 12th day of the month preceding the month in question.
Thus, for the month of December 2020, applications must be submitted via MyGuichet.lu between 1 and 12 November 2020 inclusive and so on for the following months.
The company, or its representative (e.g. a fiduciary), are required to submit the application electronically via their business eSpace on the MyGuichet.lu platform. The person submitting the application must have a LuxTrust product (e.g. Token, Smartcard or Signing stick) or an electronic identity card.
